Registration of Pharmacy Premises

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (14.04.2009) to approve registrations of Pharmacy premises under the Medicines (Jersey) Law 1995.

The Assistant Minister approved the registration of both CITRiche Ltd, 2A Dumarais Corner, St Ouen, JE3 2GG and Millbrook Pharmacy, Lisbon House, Millbrook, St Lawrence, JE3 1LL as pharmacies in accordance with the provisions of Article 74 of the Medicines (Jersey) Law 1995 and with immediate effect.

Registration of Pharmacy Premises

 

 

1.             Background

 

Two applications have been received from Mr T Aubin, Superintendent Pharmacist for CITRiche Ltd, in accordance with Article 74 of the Law, for the registration of premises as a pharmacy following a change in ownership of a retail pharmacy business and also for the registration of a new pharmacy premises.

 

2.             Applications

 

2.1.      The premises at 2A Dumarais Corner, St Ouen was previously registered as a pharmacy under the name of St Ouens Pharmacy. Article 75(1) of the Medicines (Jersey) Law 1995 provides that the existing registration of a pharmacy premises becomes void 28 days after any change in ownership of a retail pharmacy business. A new owner therefore needs to apply for the premises to be restored to the register. An application has been received to restore the premises to the register under the trading name of CITRiche Ltd.

 

         Security arrangements meet the necessary requirements of the Medicines (Jersey) Law 1995 and the Misuse of Drugs (Jersey) Law 1978. Arrangements made for the sale and supply of medicinal products are considered satisfactory

 

2.2.      Following relocation Millbrook Pharmacy, Lisbon House, Millbrook, St Lawrence an application for the registration of a new pharmacy premises has been received.

 

Security arrangements meet the necessary requirements of the Medicines (Jersey) Law 1995 and the Misuse of Drugs (Jersey) Law 1978. Arrangements made for the sale and supply of medicinal products are considered satisfactory

 

 

3.             Recommendation

 

The Minister is requested to approve the registration of both CITRiche Ltd, 2A Dumarais Corner, St Ouen, JE3 2GG and Millbrook Pharmacy, Lisbon House, Millbrook, St Lawrence, JE3 1LL as pharmacies in accordance with the provisions of Article 74 of the Medicines (Jersey) Law 1995 with immediate effect.
