Road Traffic Parking - Disabled Persons Amendment.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Road Traffic Parking - Disabled Persons Amendment.

TRANSPORT AND TECHNICAL SERVICES

ROAD TRAFFIC ( ST HELIER ) ( JERSEY ) ORDER 1996 AND ROAD TRAFFIC (DISABLED PERSONS) (PARKING) ( JERSEY ) ORDER 2005

Purpose of the Report

To amend the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

Background

On the 28th November 2005, the Environment and Public Services Committee passed a temporary Order under Article 68 of the Road Traffic (Jersey) Law 1956, for a period not exceeding twelve months, to allow additional parking spaces, unloading bays, a disabled bay, and taxi ranks, in and near the town centre, on a trial basis.

Discussion

The Environment and Public Services Committee and the St Helier Roads Committee jointly wished to continue to encourage trading opportunities, and shopping in the town centre. They therefore considered it to be desirable to maintain the availability of short term parking spaces near to shops and businesses, and therefore increase the number of on street parking spaces available. Following consultation with the Parish it has now been agreed that the trial has been a success. It has therefore become necessary for these changes to be incorporated in the Road Traffic (St Helier) (Jersey) Order 1996 before the temporary Order expires.

Under the above Article the Committee approved the following: -

1. 10 minute disc “shoppers loading” spaces in Beresford Street, to allow shoppers to park to collect goods already purchased and stored in lockers situated in the Market.

2. 20 minute pay card parking spaces in:- Museum Street, Val Plaisant, La Motte Street, Old St Johns Road, St James Street, and La Colomberie.

3. 1 hour pay card parking spaces in:- Cannon Street, Patriotic Street, Kensington Place, Hue Street, Great Union Road and Great Union Street.

4. Unloading bays in: - Val Plaisant, Aquila Road, and Great Union Road.

5. The Committee also agreed to make the section of Great Union Street, from Great Union Road to Devonshire Place subject to a one way restriction, due to the reduced road width arising from the new parking spaces.

Additional Taxi Ranks

Taxi ranks are not scheduled in the parish traffic orders. However two new ranks were created, under the Article, in Beresford Street. The rank outside “La Cala”, to operate between 7pm and 8am to cater for patrons of night clubs in the area, and at other times is available to public pay card parking, and the rank outside of the market to operate a 24 hour basis. It is now proposed to change the Taxi Rank outside “La Cala” in Beresford Street to a 24 hour basis (which will require the removal of the daytime paycard parking spaces) and to replace the Taxi Rank outside of the Market, in Beresford Street, with additional “shoppers loading” spaces.

The additional taxi rank was installed as a result of the re-location of the Broad Street Rank to Library Place.

Further amendments requested by the Parish of St Helier

In addition the Parish has requested several further amendments to the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005, as follows: -

1. The reduction of the time limit of the current two disabled persons parking bays in the Parade, from 4 hours to 1 hour limit, and the addition of two further 4 hour disabled parking bays in the Parade.

2. The installation of one additional disabled parking bay in Great Union Road.

3. Moving the location of the disabled persons parking bay in Clarence Road to a more suitable location.

4. Re locate the motorcycle parking facility from its current position in Providence Street to two new locations in Charles Street and Phillips Street, and create 1 hour pay card parking in place of the current motorcycle parking facility in Providence Street.

5. Re-locate two disabled persons’ parking spaces from Columbus Street to Albert Street.

Reasons for the requests

1. The request to reduce the two existing disabled persons parking bays in the Parade, from four hours to one hour, is an attempt to ensure access for disabled persons attending the new Customer Services Department at Cyril Le Marquand House. The two new four hour disabled parking in this area are required to maintain the existing number of four hour spaces currently available.

2. The Parish Roads Committee has requested a disabled persons parking bay in Great Union Road, near St Simon’s Church, as part of the policy of catering for disabled persons parking needs.

3. The request in re locate the disabled persons parking bay in Clarence Road, closer to its junction with Don Road, is to prevent motorists from parking illegally in front of the current disabled persons parking bay thereby causing difficulty in getting into, and out of the bay.

4. The request for the current motorcycle parking facilities in Providence Street to be moved to Phillips Street, and Charles Street, is due to complaints from residents, of motorcycle fumes entering their houses. The Parish Roads Committee feel that for health and safety reasons that the motor cycle parking should be moved to the more suitable locations in Phillips Street and Charles Street. The Parish request that the current motorcycle parking facility be replaced with 1 hour pay card parking. Signs have been posted in the area showing the proposed changes, and the Parish has received no adverse comments.

5. The request to re locate the two disabled person’s parking spaces from Columbus Street to Albert Street is to allow a resident of Columbus Street, who has recently constructed a house, and integral garage, to access his garage. Due to the narrowness of the road he is currently experiencing difficulty parking in his garage, due to the disabled parking spaces being situated on the opposite side of the road to his property.

Residents Parking

The Residents Parking Coordinator for the Parish of St Helier has submitted requests, for consideration by the Minister, for adjustments to the existing residents parking scheme in the St Mark’s Road - Stopford Road area, and a new residents parking scheme in the Richmond Road area as detailed in the attached documents, prepared by the Residents Parking Coordinator.

The adjustments requested to the existing Residents Parking Scheme are as follows:-

1. Visitor parking currently free in the evenings to be changed to pay card only.

2. Provide business permits valid from 08.00 to 18.00 hours at a reduced fee of £150.

3. Formalise the motorcycle parking in Stopford Road and introduce motorcycle parking in Chevalier Road.

1. Allow residents to park in the three doctors parking spaces in the zone between 18.00 and 08.00 hours.

2. Change a sign in Oxford Road to convert a free space into residents parking.

3. Convert the Janvrin Road unloading bay into residents parking.

4. Change the Stopford Road unloading bay into a 20 minute unloading bay between 8am and midnight with the bay being available to residents outside of these hours.

5. Provide two additional residents parking spaces in Apsley Road.

6. Provide 1 additional residents parking space in St Mark’s Road.

Details and reasons for the requested new Residents Parking Scheme in the Richmond Road area are attached.

Recommendation

The Minister is recommended to approve the requests.
