POLICING OF PARKS (JERSEY) REGULATIONS 2005 - AMENDMENT
Purpose of the report
For the Minister to approve an amendment to the Policing of Parks (Jersey) Regulations 2005 and direct officers to arrange for the matter to be lodged ‘au Greffe’ for consideration by the States.
Background
The Minister for Infrastructure has agreed to an amendment to the above Regulations with regard to:-
- Designating the Moignard Liberation Garden as a park
- Designating the Elephant Park as a park
Discussion
The Moignard Liberation Garden opened on 9 May 2016 and the Connétable of St Lawrence has requested that it be included under the Policing of Parks (Jersey) Regulations 2005.
This amendment will designate the Moignard Liberation Garden as a ‘Park’ and as such, enable the Parish to effectively police the area.
To ensure that dogs are kept under control, the Moignard Liberation Garden will be designated under ‘Part 2’ of the Regulations which allows a person to take a dog into the park provided the dog is kept on a lead.
The Elephant Park is a children’s play area owned by the Parish of St Brelade that is not currently included in the Policing of Parks (Jersey) Regulations 2005.
The Parish is experiencing problems with dogs being exercised in the play area which is leading to complaints from other members of the public. The Parish have erected “No Dogs Allowed” signs but this has had little effect.
The Connétable of St Brelade has requested that the Elephant Park should be included under the Policing of Parks (Jersey) Regulations 2005.
This amendment will designate the Elephant Park as a ‘Park’ and as such, enable the Parish to police the area more effectively. To ensure that dogs are prohibited entirely, the Elephant Park would be designated under ‘Part 5’ of the Regulations which prohibits a person taking an animal into the park, unless that person is in charge of an assistance dog or is a police officer or an officer of the Impôts working that dog in the course of his or her duty.
Recommendation
The Minister approved the Draft Policing of Parks (Amendment No. 6) (Jersey) Regulations 201- and directs Officers to arrange for the matter to be lodged ‘au Greffe’ for consideration by the States at the earliest opportunity.
Reason(s) for Decision
At the request of the Connétables of St Lawrence and St Brelade to amend the Policing of Parks (Jersey) Regulations 2005 to designate Moignard Liberation Garden and the Elephant Park as parks.
Action Required
Officers to forward the Draft Policing of Parks (Amendment No. 6) (Jersey) Regulations 201- to the Greffier of the States to be lodged ‘au Greffe’ for consideration by the States at the earliest opportunity.
