Capital Allocation for Safe Cells.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REQUEST TO MINISTER FOR TREASURY AND RESOURCES FOR PERMISSION TO UTILISE SOME CAPITAL ALLOCATED FOR FUTURE PRISON CAPITAL PROGRAMME FOR MINOR CAPITAL IMPROVEMENTS TO THE EXISTING BUILDINGS TO PROVIDE ‘SAFER’ CELLS

1. The Purpose of the Report

1.1 The report seeks the Minister’s approval to request permission to utilise future prison capital allocation to undertake improvements to the current buildings to provide ‘safer’ cells.
 

2. The Issue

2.1 Following the reports by the Prison and Probation Ombudsman of England and Wales into the two deaths in custody that occurred in 2006 and early 2007, it was identified that the prison lacked adequate ‘safer’ cell provision.

2.2 The aim of ‘safer’ cells is to minimise the number of ligature points available within a cell. One of the key aspects to this is the conventional cell window with bars. A ‘safer’ cell window is available that virtually eliminates ligature points from the windows.

2.3 Our two recent cell blocks (H and J wings) were not fitted with such windows due to cost constraints at the time of construction.

2.4 It is proposed that all windows in H, J wings and E wings are changed to the ‘safer’ type. This is the accommodation that will remain in use after the completion of the next cell block.

2.5 The cost of this work is expected to be in the region of £400,000 and cannot be found from our minor capital budget.

2.6 Funds have been identified for the prison capital programme for future years but no decisions have been made to identify the work to be undertaken. It is suggested that this is a source of funds for the windows.

3. Recommendation

3.1 The Minister is asked to approve a request to the Minister for Treasury and Resources to utilise a future capital fund for the purpose of converting existing cells to ‘safer’ cells.
