Budget and Transfer of Posts from Health and Social Services Department to Chief Minister's Department and Department of Community and Constitutional Affairs: Public Health Services Functions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Transfer of budgets in respect of Public Health Services functions from H&SS to CMD and CCA

Subject:  Transfer of recurring revenue budgets and associated Full Time Equivalent posts (FTEs) from the Health and Social Services Department (“H&SS”) to the Chief Minister’s Department (“CMD”) and the Department for Community and Constitutional Affairs (“CCA”) in respect of a range of Public Health Services functions.

Decision(s): The Minister approved the following transfers of budget and FTE and associated income and expenditure balances with effect from 1 January 2017.

 

  • the transfer of a net recurring revenue budget in the sum of £896,300 and 12.0 FTE from the Health and Social Services Department to the Department for Community and Constitutional Affairs’ (“CCA”) revenue head of expenditure in respect of the Medical Officer of Health, Strategic Public Health Unit and Professional and Care Regulation functions.

 

  • a recurring revenue budget transfer of £164,200 and 3.0 FTEs from the Health and Social Services Department to the Chief Minister’s Department (“CMD”) in respect of the Health Intelligence function.

 

 

Reason(s) for Decision:   

Article 18(1)(c) of the Public Finances (Jersey) 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

To comply with P.67/1999 which charges the Minister for Treasury and Resources to regulate the number of persons that may be employed by the States and delegation 2.3 in which authority is delegated to the Treasurer of the States for agreeing non-contentious increases to States staffing levels.

 

 

The decision is required in order to transfer resources from H&SS to CCA and CMD to:

  • establish the Strategic Public Health Unit with the Chief Officer of CCA as accounting officer,
  • transfer the Medical Officer of Health’s reporting line for strategy and policy to the Chief Minister, and
  • transfer accounting officer responsibility for the Health Intelligence Unit to the Chief Officer of CMD.

 

 

Resource Implications: Health and Social Services Department revenue head of expenditure will decrease by a total of £1,060,500 and 15.0 FTEs with effect from 1 January 2017.

 

The Community and Constitutional Affairs Department revenue head of expenditure will increase by £896,300 and 12.0 FTEs.

 

The Chief Minister’s Department revenue head of expenditure will increase by £164,200 and 3.0 FTEs.

 

 

This decision does not result in an increase to the net revenue budget or overall FTE of the States.

Action required: Head of Decision Support to advise the Acting Assistant Finance Director – HSSD and the Medical Officer of Health once this decision has been approved.
