Budget and staff transfer from Health and Social Services to Education: Alternative Curriculum Service

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Transfer of 1 FTE and associated funding of £28,700 per annum to the Education Department from Health and Social Services (HSSD) for Admin Support for the Alternative Curriculum Service.

Officer recommendation:  The Minister is recommended to approve the transfer of 1 FTE and a budget transfer of £16,750 in 2016 (covering 7 months) and £28,700 (12 months) recurrently from 2017 to the Education Department from HSSD. 

Decision(s): The Minister approved the transfer of 1 FTE and a budget transfer of £16,750 in 2016 (covering 7 months) and £28,700 (12 months) recurrently from 2017 to the Education Department from HSSD.

Reason(s) for Decision: With the impending retirement of the post holder and due to the budget being held by Health and Social Services Department and not with the Education Department, the recruitment process cannot be commenced. There is a risk that the Alternative Curriculum Service would not be able to operate efficiently without the level of Business Support provided by this post.

 

Article 18(1)(c) of the Public Finances (Jersey) 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. Delegation 1.2 delegates authority for non-contentious transfers between heads of expenditure of up to £1,000,000 to the Treasurer of the States.

 

To comply with P.67/1999 which charges the Minister for Treasury and Resources to regulate the number of persons that may be employed by the States and delegation 2.3 in which authority is delegated to the Treasurer of the States for agreeing non-contentious increases to States staffing levels.

Resource Implications:  The Education Department revenue head of expenditure to increase by £16,750 in 2016 and £28,700 from 2017 onwards, and the approved Education Department FTE limit to increase by 1.0 FTE.  The HSSD approved FTE limit and revenue head of expenditure to decrease by identical amounts.

Action required:   Finance Manager of Education Department to request the approval of the Minister for Treasury and Resources for the transfer.
