A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Accounting Standards: Proposals for Law Drafting – Public Finances (Accounting Standards) (Jersey) Order 201-

 

  1. Purpose of Report

The purpose of this report is to obtain the permission of the Treasury and Resources Minister to agree to the following amendments to the Public Finances (Accounting Standards) (Jersey) Order.

 

  1. Background

The Public Finances (Jersey) Law 2005 states that the annual financial statements of the States must be prepared in accordance with generally accepted accounting practice and accounting standards prescribed by an Order made by the Minister.

 

In Ministerial Decision MD-TR-2012-0020, the Minister recognised that accounting standards are not fixed, that they evolve over time. The Minister’s policy is to update the accounting standards adopted by the States on an annual basis, following those standards adopted by the UK Government in their annually updated Financial Reporting Manual.

 

The Minister has, for 2010 and 2011, adopted the standards implemented by the UK central government with a two year delay in the form of the Jersey Financial Reporting Manual (JFReM). The Minister notes that in 2010 the UK moved to reporting under International Financial Reporting Standards (IFRS), and has decided to adopt IFRS on the same two year delay principle. However, the Minister intends to use this change as an opportunity to reduce the delay in adoption of standards to a single year. Therefore it is the Minister’s policy that the Jersey FReM for 2012 will adopt IFRS in line with the UK FReM for the year ending March 2011.

 

  1. Comments

The Jersey Financial Reporting Manual has been redrafted based on the UK FReM for the year ending March 2011, adapted as appropriate for the public sector in Jersey. This version of the JFReM should be incorporated into the Ministerial Order in force for the 2012 Financial Report and Accounts.

 

  1. Recommendation

The Minister for Treasury and Resources is recommended to approve the Head of Financial Management, Accounting and Reporting to instruct the Law Draftsman to prepare the Public Finances (Accounting Standards) (Jersey) Order 201-.
