Budget transfer from Haut de la Garenne to Community and Constitutional Affairs Department: Consultation regarding future use of Haut de la Garenne site

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  The transfer of £50,000 from the Haut de la Garenne capital head of expenditure (FA0MF18022) to the Community and Constitutional Affairs Department revenue head of expenditure to fund consultation works regarding the future of the Haut de la Garenne site.

 

Decision(s):  The Minister approved a non-recurring budget transfer of £50,000 from the Haut de la Garenne capital head of expenditure (FA0MF18022) to the Community and Constitutional Affairs revenue head of expenditure to fund consultation works regarding the future of Haut de la Garenne.

 

Reason(s) for Decision:

Article (18)(c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be transferred from one head of expenditure to another head of expenditure for any purpose.

 

Delegation 1.2 delegates authority for non-contentious transfers between heads of expenditure of up to £1,000,000 to the Treasurer of the States.

 

The public consultation regarding the future of the Haut de la Garenne building will be led by the Community and Constitutional Affairs Department, however the 2018 Annual Budget Statement allocated the £50,000 funding to its own capital head of expenditure. This decision allocates the funding to the correct head of expenditure.

 

Resource Implications:  The Haut de la Garenne capital head of expenditure (FA0MF18022) to reduce from £50,000 to Nil and the Community and Constitutional Affairs Department revenue head of expenditure to increase by £50,000. This decision does not change the total amount voted by the States.

 

Action required:  DfI Finance Manager to inform Head of Decision Support, Treasury & Resources that the decision has been signed.

  1. Purpose of Report

 

To allow the Minister for Infrastructure to approve the transfer of £50,000 from the Haut de la Garenne capital head of expenditure (FA0MF18022) to the Community and Constitutional Affairs Department revenue head of expenditure to fund consultation works regarding the future of the Haut de la Garenne site.

 

 

  1. Background

 

The Independent Jersey Care Inquiry report recommendation 8c recommended that the States of Jersey demolish the Haut de la Garenne buildings. In response to this recommendation the 2018 Annual Budget Statement created a new capital head of expenditure called Haut de la Garenne, and allocated £50,000 to this head of expenditure. This capital head of expenditure sits under the Department for Infrastructure.

 

The £50,000 was allocated for a public consultation and feasibility work around the future of the Haut de la Garenne building in recognition of the commitment to the recommendation made in the Independent Jersey Care Inquiry report. A public consultation will give the Island’s residents an opportunity to steer what the future use of the building and site should be.

 

This work will be led by the Community and Constitutional Affairs Department, therefore this decision transfers the budget to that department.

The Minister is recommended to approve the transfer of £50,000 from the Haut de la Garenne capital head of expenditure (FA0MF18022) to the Community and Constitutional Affairs revenue head of expenditure to fund consultation works regarding the future of the Haut de la Garenne site.
