Amendments to the Road Traffic (St. Clement) (Jersey) Order 1987.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):   The Minister agreed to amend the Road Traffic (St Clement) (Jersey) Order 1987.

Reason(s) for Decision:

  1. To make La Rue de la Houguette and La Rue du Prince subject to a 6 feet 6 inches width

       restriction.

2. To extend the current prohibition of waiting restriction on both sides of La Rue du

     Maupertuis. 

3. To make both sides of La Rue de la Chapelle subject to a prohibition of waiting restriction.

TRANSPORT AND TECHNICAL SERVICES.  

REQUEST FROM THE PARISH OF ST CLEMENT FOR AN AMENDMENT TO THE ROAD TRAFFIC (ST CLEMENT) (JERSEY) ORDER 1987  
 
 

Purpose of the Report  

To amend the Road Traffic (St Clement) (Jersey) Order 1987 

Background

 

The Connétable of St Clement, after consultation with this Department, has requested the Minister for Transport and Technical Services to pass an Order as follows:- 

1. Make La Rue de la Houguette, and La Rue du Prince subject to a 6 feet 6 inches width restriction.

 

2. Extend the current prohibition of waiting restriction on both sides of La Rue du Maupertuis, from the eastern boundary of the Good Companions Club to the eastern entrance of Clos de la Mare. 
 

3. Make both sides of La Rue de la Chapelle subject to a prohibition of waiting  restriction. 

Discussion

The request with regard to La Rue de la Houguette and La Rue du Prince is considered necessary due to the narrowness of these two parish country  roads. These roads were previously made subject to a Temporary Order under Article 34 (now Article 68) of the Road Traffic (Jersey) Law 1956, for a period not exceeding twelve months. This temporary Order has now expired, and the Parish have requested that the restrictions be made permanent and included in the Road Traffic (St Clement) (Jersey) Order 1987.  

The request with regard to La Rue du Maupertuis is considered necessary due to the residents of housing estates in the area having their visibility obscured by cars and commercial vehicles parking in the area, often in a dangerous and indiscriminate manner. (Yellow prohibition of waiting lines have recently been installed by the Parish).

The request with regard to La Rue de la Chapelle is considered necessary as the parking of vehicles in this narrow Parish Road, that runs in front of St Clements Primary School, pose a danger to pupils, and other pedestrians crossing the road. (Yellow prohibition of waiting lines, and two speed bumps have recently been installed by the Parish).     

Recommendation  

The Minister is recommended to approve the requests.

2. To extend the current prohibition of waiting restriction on both sides of La Rue du Maupertuis

 

3. To make both sides of La Rue de la Chapelle subject to a prohibition restriction. 

               

Action Required  

The Minister to request Officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.
