Shipping (Fees) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister made the Shipping (Fees) (Jersey) Order 2013.

 

Reason(s) for Decision:

  • As a result of agreement with the United Kingdom and the anticipated making of the Shipping (Safety Code – Yachts and Small Ships) (Jersey) Regulations 2013 it will be possible for commercial ships up to 400gt to be registered in Jersey - The fees for survey work and certification are set at the same rate as are already charged for similar work on smaller or different classes of ships. There is no increase in existing fees.
  • The Minister requested preparation of the amending Order by Ministerial Decision MD-E-2013-0058 on 5 June 2013. The amendment has now been prepared and is ready for signature.

Resource Implications:

 

There are no new financial, property, ICT or human resources issues arising. The associated additional survey and certification work which may arise will be carried out by the Jersey Marine Surveyor or approved Recognised Organisations. The work is carried out on a strictly user-pays fee basis.

The Greffier is requested to take the necessary action for notifying the States Assembly and for publication of the Order.

Report

 

 

Background

 

Under Article 193 of the Shipping (Jersey) Law 2002 the Minister is empowered to charge fees for the issuing of certificates and documents and for doing anything under the Law.

 

The British Registry of Ships in Jersey is expected to function as far as possible on a user-pays basis. The current scale of fees is set out in the Shipping (Fees) (No. 2) (Jersey) Order 2008 as it was amended in 2011.

 

 

Considerations

 

In 2012, the Registry appointed a marine surveyor. This was not only to oversee surveys and certification work carried out by external Certifying Authorities but also to carry out work directly on the Registry’s behalf. Fees for this work now need to be added to the existing list.

 

In addition, the United Kingdom has recently passed a new Categorisation Order (The Merchant Shipping (Categorisation of Relevant British Possessions) (Amendment) Order 2013. This will allow Jersey to register commercial vessels up to 400gt and such registration brings with it additional tasks, the cost of which need to be passed on.

 

 

The Proposed Fees

 

The fees are not for work previously carried out at no charge to the customer. They are set at the same level that is already charged for similar work on smaller or different classes of ships. There is no increase in existing fees.

 

The Law Draftsman has prepared the amending Order which is now ready for signing.
