Item for inclusion in the 2009 legislation programme.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

  1. The Minister agreed that the following bids for the 2009 Law Drafting Programme should be forwarded to the Council of Ministers for their consideration –
    • Amendments to Public Finances (Jersey) Law 2005.

 

  1. The Minister approved the submission of a form to the Council of Ministers which indicates whether the above bids should be regarded as ‘essential’ or ‘desirable’.

Reason(s) for Decision:

Further information in support of the proposed inclusion of the item(s) in the 2009 Law Drafting Programme is given in the Legislation Request Questionnaire(s) that will be forwarded to the Council of Ministers.

Resource Implications:

This decision should result in improved financial performance for the States.

Action required:

The Business Manger will arrange for the Legislation Request Questionnaire(s) to be collated and submitted to the Council of Ministers for their consideration.

REPORT TO TREASURY AND RESOURCES MINISTER  
 

Law Drafting Programme 2009: Bid(s) for Inclusion  

1.  The Treasury and Resources Minister is asked to approve requests for items of legislation to be included in the 2009 Law Drafting Programme. Further information about these requests, and why they should be included in the Programme, is given in the attached Legislation Request Questionnaire(s). 

  1. The items proposed for inclusion are as follows:-

 

  • Amendments to Public Finances (Jersey Law) 2005

 
 

  1. This list will be discussed by the Council of Ministers and, subject to approval by the Council, forwarded on to the States for consideration as part of the 2009 Business Plan.

 

4. In addition to the Legislation Request Questionnaires, the Minister is also asked to approve the submission of a form to the Council of Ministers which indicates whether the Legislation Request(s) for 2009 should be regarded as ‘essential’, ‘highly desirable’ or ‘desirable’. 

5.   Subject to approval by the Minister, the above forms will be collated and submitted to the Corporate Management Board for an initial draft prioritisation. They will then be forwarded to the Council of Ministers for their consideration, and subsequently a recommended draft programme will be included as part of the 2009 Business Plan for consideration by the States.
