Register of British Ships in Jersey: Removal of Vessel: Solay

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Removal of the vessel SOLAY from the Register of British Ships in Jersey

 

Decision(s):

The Minister decided to direct the Registrar to terminate the registration of the vessel in question.

 

Reason(s) for Decision:

There are grounds that the vessel is not an appropriate one to continue to be held as a registered Jersey vessel. These are explained in the attached report.

 

These grounds are not the normal grounds relating to safety or pollution that would allow the Registrar to act on his own. However, Article 12 (3A) of the Shipping (Jersey) Law 2002 empowers the Minister to direct the Registrar to terminate the registration, having “regard to the interests of Jersey” ………. [&] considering “that it would be inappropriate for the ship to be, or, remain, registered”

 

Resource Implications:

There are no new financial, property, ICT or human resources issues arising.

 

Action required:

The Registrar is to remove the vessel from the Register in accordance with the Law and the relevant Regulations.

Removal of a Vessel from the Register of British Ships in Jersey

 

Circumstances

 

On 25 August 2015, the sailing yacht SOLAY was reported as being seized, along with motor vehicles, near the Australian port of Southport. The yacht’s skipper and related persons were arrested. The yacht was found to be carrying quantities of cocaine. The total quantity found on board and in the vehicle has been valued at AUS $17m, as detailed in various reports such as that published by the Australian Broadcasting Corporation – http://www.abc.net.au/news/2015-08-25/cocaine-seized-from-yacht-on-qld-gold-coast-police-say/6723488

 

Illegal activity such as this cannot be tolerated and the Minister can be satisfied that it is not in Jersey’s interests to keep the vessel registered in the Island.

 

Legal Powers

 

Article 12 (3A) of the Shipping (Jersey) Law 2002 empowers the Minister to direct the Registrar to terminate the registration, having “regard to the interests of Jersey” ………. [&] considering “that it would be inappropriate for the ship to be, or, remain, registered”

 

Related Actions

 

The Jersey Customs and Immigration Service have been in contact with the office of the Registrar and the Australian authorities. They are being asked to keep the Registrar informed if there are any related matters of which he needs to be aware. As the vessel is reported as having been impounded it may also be possible to ensure the return of any relevant documents and the removal of identifying marks associated with the Island.

 

Termination would end the Registry’s involvement and ensure that it would not be party to any further transactions concerning the vessel.

 

Recommendation

 

The Minister is requested to direct the Registrar to terminate the registration of the vessel.
