Jersey Community Relations Trust: Appointment of States Member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister decided to present a Report to the States, giving 15 days’ notice of his intention to appoint Deputy Sean Power as a Trustee of the Community Relations Trust, in pursuance of paragraph 5.1 of the constitution of the Trust, as amended.

Reason(s) for Decision:

In pursuance of Paragraph 5.1 of the Trust Constitution, the Minister is required to give the States 15 days’ notice of his intention to appoint Deputy Sean Power as a Trustee of the Jersey Community Relations Trust before confirming the appointment.  The appointment would be for a further period of 4 years, or until he ceases to be a member of the States, whichever shall be the shorter.  Deputy Power was appointed to the position of States appointed Trustee to the Trust on 29 April 2009 for a period of 3 years and that tenure is shortly due to expire.  All States members were written to in March 2012, inviting them to express interest in becoming a Trustee and Deputy Power was the only States member to put his name forward.

Resource Implications:

There are no resource implications to the Home Affairs Department resulting from this decision.

Action required:

The Executive Officer to request the Greffier of the States to arrange for the attached Report to be presented to the States.

Jersey Community Relations Trust: Appointment of States Member

REPORT

 

On 29 April 2009 Deputy S Power was appointed to the position of States appointed Trustee to the Jersey Community Relations Trust for a period of 3 years.  That tenure is shortly due to expire.

Since the appointment of Deputy Power, the constitution of the Trust has been revised and now states that the Minister for Home Affairs, having given at least 15 days notice to the States of Jersey of his intention, shall appoint one Trustee, being a member of the States of Jersey, who is committed to the objectives of the Jersey Community Relations Trust.  Trustees are now also ordinarily appointed for a period of 4 years.  The Committee consists of a Chair, appointed by the Minister for Home Affairs; a States member appointed by the Minister for Home Affairs and a further five Trustees, who are not States Members and who are appointed by the existing Trustees. 

On 13 March 2012, the Minister for Home Affairs wrote to all States Members to give them the opportunity to express interest in becoming a Trustee of the Jersey Community Relations Trust.  They were asked to notify the Minister if they wished to be considered for the role and to submit a written statement of a maximum of 500 words in support of their application, setting out their reasons for wishing to be appointed and why they support the aims of the Trust.  The Appointments Commission were invited to be involved in the short listing and interview process.

Ultimately, the only States Member to express an interest in being a Trustee of the Trust and to provide a written statement was Deputy S Power.  The need for the Appointments Commission to be involved in the process therefore falls away.

Deputy Power has demonstrated his commitment to the objectives of the Trust and the Minister for Home Affairs therefore gives notice to the States of his intention to reappoint Deputy S Power as a Trustee to the Jersey Community Relations Trust for a period of 4 years or until such time as Deputy Power leaves the States, whichever shall be the shorter.
