Minimum Wage - Amendment (P.135/2013): Comments of the Minister for Social Security

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Minimum wage hourly rate - Comment presented to the States in response to P.135/2013, ‘Minimum Wage: Amendment’.

Decision(s): The Minister decided to present to the States a comment explaining why he will oppose a Proposition lodged by Deputy G.P. Southern (P.135/2013).

Reason(s) for Decision: The Proposition asks the Minister to set the minimum wage at £6.77 from 1 April 2014. This is 14 pence more per hour than the rate that has been fixed by the Minister, by Order, as recommended by the Employment Forum in September 2013 (MD-S-2013-0093).

 

The Employment (Minimum Wage) (Amendment No. 7) (Jersey) Order 2013 will increase the hourly rate of the minimum wage to £6.63 from 1 April 2014. The Minister made the Order on 25 October 2013 (MD-S-2013-0105).

 

The Minister will oppose the Proposition when it is debated by the States on 3 December 2013. The Minister will then ask the States to approve the Employment (Minimum Wage) (Amendment No. 10) (Jersey) Regulations 2013 (P.131/2013) which would, from 1 April 2014, increase the maximum values that may be counted towards minimum wage or trainee rate pay where accommodation, or accommodation with food, is provided to an employee.
