Assistant Chief Minister: Appointment and transfer of Financial Services responsibility

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report Title: Transfer of Financial Services and appointment of Assistant Chief Ministers

Public

Decision(s):  The Chief Minister has confirmed her intention to transfer political and legal responsibility for financial services from the Minister for External Relations and Financial Services to the Chief Minister and requests that an Order be prepared to this end in accordance with Article 29A(1) of the States of Jersey Law 2005 (“the 2005 Law”).

 

 

The Chief Minister also confirms the appointments of Deputy Elaine Millar and Deputy Ian Gorst as Assistant Chief Ministers in accordance with Article 25(1)(a) of the 2005 Law, effective immediately.  Following the legal transfer of financial services, Deputy Millar and Deputy Gorst will be delegated responsibility for financial services.  A Ministerial Group for financial services, chaired by Deputy Millar who will take primary responsibility for Financial Services, and also comprising the Chief Minister and Deputy Chief Minister, will be established.

 

Whilst this transfer of legal responsibility takes place, Deputy Elaine Millar is to be appointed as an Assistant Minister for External Relations and Financial Services, and delegated responsibility for financial services.  This appointment will expire at the point that legal responsibility for Financial Services transfers to the Chief Minister.  The Chief Minister gives consent to this extension.

 

Reason(s) for Decision:

 

The Chief Minister has decided to transfer political and legal responsibility for financial services from the Minister for External Relations and Financial Services to the Chief Minister.

 

As a result of this decision, the Chief Minister has appointed Deputy Elaine Millar and Deputy Ian Gorst as Assistant Chief Ministers, as per Article 25(1)(a) of the States of Jersey Law 2005 which permits the Chief Minister and Ministers to appoint one or more elected members as an Assistant Minister.

 

In addition, the Chief Minister has provided consent to the appointment of Deputy Elaine Millar as an Assistant Minister for External Relations and Financial Services, whilst the transfer of legal responsibility takes places, as per Article 25 (2) which requires that a Minister may only appoint (or dismiss) an Assistant Minister with the prior consent of the Chief Minister.

Action required:

 

The Chief Minister’s Private Office to:

 

  1. Submit drafting instructions to the Principal Legislative Drafter for an Order to be prepared to transfer political and legal responsibility for financial services from the Minister for External Relations and Financial Services to the Chief Minister.

 

  1. Inform Ministers when the decision has been signed, confirming the above (I) and (III) and also confirming Deputy Elaine Millar and Deputy Ian Gorst as Assistant Chief Ministers.

 

  1. Inform the Ministers for External Relations and Financial Services of the Chief Minister’s consent to appoint Deputy Elaine Millar as an Assistant Minister for External Relations and Financial Services whilst the transfer of legal responsibility for financial services takes place.
