Gorey Fete 2006 Road Closure application

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES

APPLICATION FOR ROAD CLOSURES AND TRAFFIC RESTRICTIONS DURING GOREY FÊTE 2006 - St MARTIN’S GYMKHANA AND FÊTE COMMITTEE

Purpose of the Report

To obtain approval of road closures for the purpose of the Gorey Fête, to be held on Thursday 17th August 2006.

Background

The promoter (St Martin’s Gymkhana and Fête Committee) has submitted details of its proposed road closures for the 2006 event. Road closures for the event are enabled by Order of the Transport and Technical Services Minister under Article 2 of the “Entertainments on Public Roads (Jersey) Law 1985”. A draft order has been prepared and circulated to the Connétables of Grouville and St Martin, as well as the Harbour Master (Jersey Harbours) for consultation in accordance with the law.

Discussion

The Order will enable the event promoter to close Gorey Pier and adjacent coach parking area for the purpose of the event, as well as to restrict traffic in the vicinity.

Restrictions for this year’s event will be similar to those of 2005 in that the Order provides for a one-way system on Gorey Coast Road, Le Mont de Gouray, Beach Road, La Route de la Côte and La Route Le Brun. These restrictions will apply from 8am on the day of the Fête until 10am the day after and are intended to reduce traffic problems, as well as aid the removal of vehicles parked on Gorey Coast Road.

The wording for this year’s Order has been amended from 2005 with respect to Article 7 at the request of the St Martin’s Gymkhana and Fête Committee. Article 7(b) now gives provision for a police officer or member of the Fête Committee to exercise discretionary power to restrict traffic, in the interests of safety of the public, where access to premises might ordinarily be granted on or adjacent to the site of the event, as set out under Article 7(a).

Other details are as per the 2005 Order.

The Minister is requested to approve the Gorey Fête (Jersey) Order 2006, as prepared.
