Le Buissonet, High Street, St. Brelade - serving of enforcement notice

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Summary

Lime Render with Ashlar Coursing was removed from this Proposed Site of Special Interest property’s façade without the consent of the Minister for Planning and Environment.

 

 

Recommendation

That an enforcement notice be served upon the owner of the property requiring that the lime render façade with ashlar coursing is replaced within 2 months of the serving of the notice. This in accordance with the provisions of Article 40 (2) (a) of the Planning and Building (Jersey) Law 2002.

 

Details

Le Buissonet is located upon the northern side of St Aubin’s High Street in the parish of St Brelade. The property has been assigned the designation of ‘proposed site of special interest’.

The property was purchased by the present owner, Miss Nadia Miller, in June 2006. Since purchasing the property and without application or obtaining the required consent of the Minister for Planning Environment, Miss Miller commissioned unknown builders to remove the property façade’s lime render to expose the granite beneath.

Once that render had been removed, the wall was pointed with Portland cement to detail the exposed granite and informal window reveals created from the same materials.

It is of the opinion of the Historic Building Section that the works were seriously injurious to this listed buildings appearance and the only course of action should be the reinstatement of the original façade with lime render and ashlar coursing detail.

To date negotiations with Miss Miller have failed to secure a remedy and therefore an enforcement notice to be served upon Miss Miller requiring such compliance is deemed necessary.

 

 

Recommendation

That an enforcement notice be served upon the owner of the property requiring that the lime render façade with ashlar coursing is replaced within 2 months of the serving of the notice. This in accordance with the provisions of Article 40 (2) (a) of the Planning and Building (Jersey) Law 2002.
