P.117/2009 Removal of Library Chambers & D'Hautree Site from Property Disposal List

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): 

The Minister approved, as agreed by the States on 5th October 2009, that Library Chambers and the D’Hautrée Site be removed from Summary Table J ‘Schedule of Properties Proposed in 2010 for Disposal’ in the States Business Plan (P117/2009) to allow time for further investigations to be undertaken to determine whether effective uses exist within the States for the land/buildings.

Reason(s) for Decision: 

To formally record acceptance of amendments to the States Business Plan P117/2009 requesting that Library Chambers and the D’Hautrée Site be retained in the ownership of the public.

Resource Implications: 

There are no manpower implications in respect of this decision. There are potential financial implications in respect of this decision insofar as a minimum one-year delay in progressing the sale of the two subject properties will impact on agreed financial targets for property disposals.

 

Action required: 

This decision is to be notified to the States.  

The Director of Jersey Property Holdings is to copy this decision to the Minister, Treasurer and Deputy Treasurer.

Property Transaction for Ministerial Decision - Minister for Treasury and Resources  

P117/2009 - The 2010 States Business Plan – Library Chambers and the D’Hautrée Site

Purpose  

To request a decision from the Minister for Treasury and Resources regarding two properties proposed for disposal in the draft 2010 States Business Plan, which properties are the subjects of proposed amendments to the plan.  
 

Background  

Jersey Property Holdings included in its schedule of 12 proposed disposals in the 2010 States Business Plan (P117/2009), the following properties: 

  • Library Chambers, 5 Library Place, St Helier

 

  • D’Hautrée Site, St Saviour’s Hill, St Saviour

 

The Minister for Education, Sport and Culture lodged an amendment (No. 12 – 08 Sept 2009) to P117/2009 proposing that the D’Hautrée Site be removed from the disposal schedule. 

Deputy Tadier lodged an amendment (No. 13 – 08 Sept 2009) to P117/2009 proposing that 5 Library Place be removed from the disposal schedule.  

It is recommended that both properties be withdrawn from the 2010 Business Plan to allow time for further investigations to be undertaken to determine whether effective uses exist within the States for the land/buildings. 

Following those further investigations, a decision will be made as to whether to include the properties for disposal in next year’s business plan (the 2011 Business Plan). 

The comments of the Council of Ministers to these amendments are included as Appendices A and B respectively to this report.

 

Recommendation 

It is recommended that, as agreed by the States on 5th October 2009, Library Chambers and the D’Hautrée Site be removed from Summary Table J ‘Schedule of Properties Proposed in 2010 for Disposal’ in the States Business Plan (P117/2009) to allow time for further investigations to be undertaken to determine whether effective uses exist within the States for the land/buildings.

APPENDIX A

The Council of Ministers accepts this amendment. 

Deputy Tadier requests that the property Library Chambers, 5 Library Place, St. Helier be removed from the schedule of properties for disposal in Table J of the Business Plan. 

As members will be aware, the Council of Ministers has accepted the proposal from the Minister for Education and Sport to remove the D’Hautrée site from the list of properties to be disposed in 2010 and thereafter, on the condition that the Minister for Education has given a firm undertaking to the States to conduct a comprehensive review of all future Education Sports and Culture (ESC) current and future accommodation needs. 

The objectives of this review are to assess all operational requirements of the Education Sport and Culture department in the context of the pressing need to deliver significant efficiencies in asset utilization by releasing properties for disposal. 

As one of the occupants of 5 Library Place is the Culture Officer for ESC, the Council of Ministers has, on reflection, decided that it would be not be appropriate to proceed with a debate on the disposal of 5 Library Place until the results of the ESC property review have been delivered. 

The initial findings of this review are to be presented to the Council of Ministers in April 2010 to ensure that properties for disposal may be properly incorporated in the 2011 business plan. 

The Council of Ministers will therefore now be accepting the amendment of Deputy Tadier to remove 5 Library Place from the 2010 property disposal list, but the property may return for consideration by States members once the ESC review has been completed.
