Advanced Planning Funding

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved advances from the ‘Planning Vote’ budget totalling £1.846 million as detailed in Table 1 in the accompanying report.

Reason(s) for decision:

The proposed funding advances relates to projects in the forward capital programme 2008 - 2011 that was approved by the States in the 2006 Annual Business Plan.

The advances are in accordance with the terms of Financial Direction 5.6.

Action required:

Treasury to action budget transfers and inform relevant departments.

advanced planning funding for CAPITAL works projects

1. Purpose of Report

1.1. The Minister is asked to approve advances of funding in respect of various capital works from the planning vote budget.

2. Background

2.1. Financial Direction 5.6 (paragraph 5.6.22 - replicated below) provides for the advancing of funds from the ‘Planning Vote’ budget to enable a capital works project to be taken up to tender stage by the year that it is in the capital programme.

Once included in the forward capital programme, the project should move into the design and development phase. Funding for this will be provided from the Central Planning Vote, normally at 75% of the project fee estimate. Funding advanced here will be reclaimed from the future capital vote allocated to the project.

2.2. The projects listed in Table 1 below require planning advances and the Minister is asked to approve them, as follows:

3. Comments

3.1. The proposed advance can be contained within the balance held in the ‘Planning Vote’ budget until it is replenished in the year each project receives full funding allocation.

4. Recommendation

4.1. That the Minister agrees the advances from the ‘Planning Vote’ budget detailed in Table 1 above.

5. Reason for Decision
