New Street, St. Helier: Dandara Site Yard on Highway Space: Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DANDARA LIMITED’S APPLICATION FOR USE OF HIGHWAY SPACE IN NEW

 

STREET FOR SITE YARD

 

 

Purpose of the Report

 

To obtain a Ministerial Decision regarding approval of Dandara Limited’s proposed use of highway space in New Street to allow the formation of a hoarded ‘site yard’ from October 2014 for a period of approximately two years.

 

 

Background

 

Hoarding (along with scaffolding and skips) is administered under the ‘Highway (Jersey) Law 1956’. Due to the close inter relationship between by-roads and main roads in St Helier, Transport and Technical Services (TTS) has, under ‘Article 6’ powers, delegated its administration role to the Parish. However, due to the sensitive location and duration of Dandara Limited’s proposed site yard the Parish has sought TTS advice and approval before issuing a licence.

 

 

Discussion

 

The Parish has been contacted by Dandara Limited (a property developer) regarding its plans to redevelop two building plots at the south end of New Street, opposite the side of Voisins Department Store. Dandara Limited has requested permission to form a hoarded site yard over the adjacent footway and carriageway (see attached Site Plan prepared by Dandara) to facilitate construction and secure the site.

 

In response TTS has, in consultation with the Parish and Dandara Limited, prepared a ‘Site Management Plan’ to address and reflect its various requirements, which must be implemented / funded by Dandara Limited as a pre-condition of its approval (see attachment).

 

 

Disabled (Mini-Bus) Parking

 

Creation of the site yard will mean the loss of one mini-bus space from the disabled (minibus) parking layby at the south end of New Street. In view of this TTS has contacted the main users of the layby to discuss alternative arrangements. In particular TTS has worked with Maison des Landes (a Hotel catering for the needs of the disabled) as a key user to identify an alternative site. With their assistance a site in Hilgrove Street has been identified, tested and agreed (see Street Management Plan). The Parish has agreed to use its powers under the ‘Road Traffic (Jersey) Law 1956: Article 68 -  Temporary modification of the effect of Orders made under Article 59, 62 or 63’ to formalise use of the space.

 

 

 

 

 

Buses and Taxis

 

A road width of 3m will be maintained allowing the ‘Number 4’ bus route and taxis to continue to travel along New Street unaffected.

 

 

Recommendation

 

The Minister is recommended to approve Dandara Limited’s application for a site yard subject to Dandara Limited’s adoption of the proposed ‘Street Management Plan’.

The proposed site yard is reasonable and justified.
