Allocation of Lottery Profits 2005 / 2006.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approves the attached Report and Proposition for lodging in the States.

Reason(s) for decision:

The Minister has responsibility, after consultation with the Public Lotteries Board, for the administration of the Jersey profits arising from the Channel Island Lottery. Section 4(5) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975 states that the Minister may set aside reserves and may utilize such reserves in connection with the exercise of his functions under these Regulations in such manner as he thinks fit, but any monies standing to the credit of the Fund which have not been set aside by the Minister shall be applied in such manner and for such purposes of public benefit as the States shall from time to time by Act direct.

Action required:

Jason Lane to send the Report and Proposition to the Assistant Greffier and the Publications Editor at the States Greffe for lodging in the States.

Allocation of Lottery Profits 2005 / 2006.

PROPOSITION

THE STATES are asked to decide whether they are of opinion -

to agree that the total Jersey portion of the profits of the Channel Islands Lottery from 2005 should be paid to the Association of Jersey Charities for the benefit of the community and the charitable needs of the Island, with 20% of profits from 2006 being transferred to the Lottery Accumulated Fund and the balance of 80% to the Association of Jersey Charities.

MINISTER FOR ECONOMIC DEVELOPMENT

REPORT

The Minister for Economic Development requests the support of the States to award the Jersey allocation of Lottery profits from 2005 to the Association of Jersey Charities. This was clearly the intension of the former Committee and not to do so would impact severely upon the Association’s revenues.

2005 produced profits of £412,805 which can, with States support, be given to the Association of Jersey Charities. The Association now represents over 200 member charities and undertakes a valuable function by considering and allocating funding to the best prepared and worthy projects put forward by its members. In doing so, the Association continues to fulfil a vital social need.

Sales of tickets for the C.I. Lottery scratch-cards have stabilised after a long-running decline and while the Department is optimistic that the present level of sales will continue this cannot be taken for granted. The profits from Draws in 2006, therefore, require some further thought. Clearly the Association of Jersey Charities should not have its funding withdrawn, but with the extension of the National Lottery to the Island (possibly in 2008/9), it seems prudent to retain funds into the Accumulated Fund as a reserve and buffer during the transition period.

To that end, it is proposed that under authority of Article 4(5) of the Gambling (Channel Island Lottery) (Jersey) Regulations 1975, up to 20% of the Jersey profits from 2006 may be transferred into the Accumulated Fund to be used at the Assistant Minister’s discretion after advice from the Public Lotteries Board.

There are no other financial or manpower implications for the States arising from this proposition.
