Jersey Energy Trust - appointment of member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The appointment of Mr David Lord as member of the Trust.

Reason(s) for Decision:

The Minister for Planning and Environment established the Jersey Energy Trust (JET) as a non-political body to provide an oversight function to support the programmes and objectives of an Energy Efficiency Service (EES). In its first phase during 2009 and 2010 the Energy Efficiency Service has delivered an energy efficiency programme to targeted low income groups (See MD-PE-2009-0114). There was a vacancy on the board for an additional member that could bring social policy experience and this candidate has now been found.

Jersey Energy Trust – Terms of Reference

1.0 Summary  

The Minister for Planning and Environment established the Jersey Energy Trust (JET) as a non-political body to provide an oversight function to support the programmes and objectives of an Energy Efficiency Service (EES). For the Group’s Terms of Reference please see MD-PE-2009-0114.  

2.0 Objectives:  

The objectives of the ‘Jersey Energy Trust’ are to: 

Phase 1 (2009/10):

·     Oversee the delivery of improvements in comfort and warmth for low income and vulnerable consumers;

·     Assist low income customers with advice and the distribution of grants for a number of energy efficiency measures such as loft and cavity wall insulation, temperature controls, lagging and draught proofing;

·     Assist in the development of a persuasive case for continuing and expanding the role of the Trust in subsequent years.

In addition during Phase 2 (20011 onwards):

·     Expand the programme to assist the domestic, industry and governmental sectors to stabilise their energy use in the built environment at 2005 levels, so avoiding a predicted 20% increase in energy demand by 2030 (as described by the Energy policy Green Paper ‘Fuel for Thought’);

·     Assist the domestic, industry and governmental sector in reducing carbon emissions from the built environment to achieve carbon reduction targets (as described by the Energy policy Green Paper ‘Fuel for Thought’);

·     Promote the use of energy efficiency measures and potentially renewable energy in schools as a learning tool linked in with the curriculum;

·     Promote and assist with the uptake of small scale renewable technologies.

 

3.0 Membership 

Members are appointed on an unpaid basis, for an initial term of 3 years. The membership was intended to represent the following skills and experience: Chairing public or voluntary bodies; Providing energy services; Assisting vulnerable groups; Assessing the impact of grant programmes. In addition there is an expert independent advisor from the UK who has previous experience in this area. Technical expertise has been provided by the Programme Director and the Departmental Sponsor (Environment Director and Assistant Director for Environmental policy).  

There has been a vacancy on the board for a member with social policy experience – a candidate has now been found and has met with the Chief Officer of Planning and Environment and Mr Chris Ambler from the Board. Mr David Lord has agreed to serve on the board and brings with him a wealth of policy experience in the socially vulnerable sector and is considered a valuable asset to the Jersey Energy Trust. 

Mr. Lord is Chairman for the Jersey Cheshire Home Foundation, and has also served five years as Chairman of the Home Management Committee. He has also been both a committee member and the treasurer of the Jersey Hospitality Association as well as a Parent Governor at Grainville School and Chairman of the Governing Body for three years. In addition Mr. Lord is an invited Governor at Highlands College and a member of the Retail Sub Committee of the Jersey Chamber of Commerce. Between 2005 and 2007 he was President of Skal International Jersey. 

Recommendation 

The Minister is asked to agree the appointment of David Lord to the board of the Jersey Energy Trust for a period of three years.
