HART flying permission

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made to approve exemptions under Articles 47 and 90 of the Air Navigation (Jersey) Order 2000 and Rule 5(i)(c) of the Rules of Air (Jersey) Regulations 2000 to permit flying training for HART to continue.

PERMISSION

Pursuant to the Air Navigation (Jersey) Order 2000, as amended, and the Rules of the Air (Jersey) Regulations 2000, permission is granted for the HART helicopter to fly from Jersey Airport at normal transit altitude and then to land or fly a small circuit at the five training areas agreed between the Assistant Minister and HART. The purpose of this permission is to permit HART to conduct winching training during daylight hours commencing at 0800 hrs on selected training days with effect from Thursday 9th February 2006 and ending at 1800 hrs on Monday May 1st 2006.

This permission is based on exemptions by the Assistant Minister to Articles 47 and 90 and to Rule 5(i)(c) (the 500' rule) and is subject to the following conditions:

  1. HART is to continue to inform the media to ensure that notice is given of flying training days.
  2. The training areas may need to be secured to keep the public and animals out; that responsibility lies with HART.
  3. This is a strictly daylight hours training exercise commencing not before 0800 hrs daily.
  4. That the appropriate insurance is in place for the aircraft, the crew members, the public, animals and any damage to ground/vegetation/building is in place.
  5. If there are a substantial number of noise or nuisance complaints this permission may be reconsidered.

 

At the beginning of each calendar month during this permission, a senior officer of HART is to brief face to face the Senior Air Traffic Control Officer in order that the Jersey Air Traffic Control Unit understands the training which is being carried out on each of the days.
