Netherlee, Le Chemin des Maltieres, Grouville - removal from Historical Building Register

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

This report has been prepared by the Jersey Heritage Trust as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the registration of historic buildings and sites. 

The Planning and Environment Department requested on 15 October 2007 that the Jersey Heritage Trust assess the architectural, historical and other interests of Netherlee ahead of discussions with the Ministerial Registration and Listing Advisory Group.

Relevant interests of the site (also see assessment form)  

Netherlee was first registered in 1992. The Jersey Building Heritage Sub-Committee considered an appeal against the registration of Netherlee in November 2000, and the Planning and Environment Committee considered a further appeal in January 2001. Both committees concluded that Netherlee should be retained on the register as a BLI.   

Netherlee was built c.1948 in the Modern Style that reached its zenith in Jersey in the 1930s. It is 2-storey with an asymmetrical composition characterised by geometric shapes with flat rendered walls, flat roof, large expanses of glass with corner windows and a porthole window.  

MRLAG considered Netherlee at its meeting on 12 November and members concluded that the house is well designed in the Modern Style and merits retention on the Register as a BLI. 

The owner submitted more detailed appeal papers at the ministerial decision meeting on 23 November and the Minister deferred a decision until this submission could be properly assessed and a site visit undertaken. 

Additional new evidence came to light at the site visit on 10 December which showed that the original form of the house had been significantly changed by the addition of corner rooms at first floor level replacing a balcony.    

JHT recommendation  

Remove Netherlee from the Register. 

Justification relating to criteria  

Netherlee fails to satisfy the criteria for the registration of 20th century buildings given that there has been significant alteration to the original form and appearance of the house.
