Waste Management (Fees) (Jersey) Order 2008.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Waste Management (Fees) (Jersey) Order 2008, and approved the accompanying report.

Reason(s) for Decision:  To enable the Department to increase the fees and charges in respect of the Waste Management (Jersey) Law 2005, in 2008 in line with Anti Inflation Strategy agreed by the States.

Action required:  That the Environmental Protection function of the Environment Division make known to waste management operators the new schedule of fees and charges to ensure that further applications made under the Waste Management (Jersey) Law 2005 are accompanied by the correct application fees. That the Greffier of the States be requested to arrange for the Order to be laid before the States.

Purpose of the Report  

The Minister for Planning and Environment is asked to approve a request to increase the fees in respect of the Waste Management (Jersey) Law 2005 in line with his approval of the general increase to the department fees and charges by means of the decision made on 27 November 2007 (ref: MD–PE–2007-0271) 

Background  

The Waste Management (Jersey) Law 2005 sets the level of fees payable for actions required by means of a subordinate Order.  The Order associated with the original legislation has allowed the application, by waste operators, for waste management licenses, waste carriers certificates, and in some cases trans boundary waste shipments during the initial period of the law’s introduction.  It is expected that now that the first “tranche” of applications  have been made, there may be more, and in accordance with Anti Inflationary measures previously agreed and approved, the fees must rise. 
 

Discussion  

The Ministerial decision referred to previously (MD-PE-2007-0271) agreed the increase in fees across the board for P&E by 2.5% and we would request that the minister confirms this specifically for fees payable under the Waste Management (Jersey) Law 2005.    
 

Recommendation  

That the Minister agrees the increase in fees as per the prior Ministerial Decision.
