Bus Service: Island Explorer: 2012 Service Proposals

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Explorer Network of Bus Services – Proposals for 2012

Decision(s):   The Minister approved the following, subject to receiving submissions from members of the public as required by Article 24 of the Motor Traffic (Jersey) Law 1935:

  1. The Explorer network will run from 07 April through to 29 September 2012 inclusive
  2. In addition nine return journeys on the Red route will operate on the following days: 30 September, 06 and 07, 13 and 14, 20 and 21, 27 to 31 October and 01 to 04 November
  3. Service 26 will continue to operate until the end of the 2011-12 Winter timetable
  4. Changes to the other routes as detailed in the report.

Reason(s) for Decision:  The proposals represent a simplification and rationalisation of the leisure network while continuing to provide an adequate service for the benefit of residents, visitors and tourist destinations.

Resource Implications:  A cost of £3,502.60 to continue Service 26 until the end of the Winter 2011-12 timetable, covered in full by funding available for bus service improvements within the Sustainable Transport budget.

Action required:

  1. Advise Connex of the decision.
  2. Prepare advertisement to be placed in the Gazette section of the JEP and media release.
  3. Circulate proposals to all Constables, Parish Halls and other interested parties.
