Increase in Intercountry Adoption Fees.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Increase in fees paid by Jersey Carers for Inter Country (Overseas) Adoption Assessments, to cover the costs incurred by Children’s Services.

Decision(s):

The Minister approved an increase in the fees payable to Children’s Services by Jersey Carers adopting a child from overseas from £2,000 to £2,750.

In addition to this, £100 is now payable for each post adoption report.

Reason(s) for Decision:

Since setting the current fees in 2001, the level of resources involved in carrying out these Assessments has been reviewed (as detailed in the Report) and an additional cost of £750 (including 2008 inflation at 2.5%) identified.

In addition, it has been identified that many jurisdictions have a requirement for post placement reports to be carried out, the cost of which, estimated to be £100, has never been charged.

The proposed fees compare favourably with those of other Jurisdictions, as shown on the Report.

Resource Implications:

Based on an estimate of 10 Jersey Carers being assessed in a year, additional income from the increase in fees would be approximately £7,500 per annum, which would enable budgets to be increased accordingly, to cover the costs.

Action required:

The Treasurer of the States has given permission to increase these fees by above the rate of inflation.

The Minister for Health & Social Services to approve the increase in fees.
