Criminal Offences Confiscation Fund - budget transfers relating to court case costs 2009

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TREASURY AND RESOURCES MINISTER

NON-ministerial Department transfers from the criminal

offences confiscation fund (“COCF”)

  1. Purpose of Report

The Minister is asked to agree to fund £2.45m criminal Court and Case Costs from the Criminal Offences Confiscation Fund (“COCF”).

  1. Background
  2. Court and Case Costs are demand-led by nature and the budgets existing in various Court Departments were not sufficient to meet the cost of cases in 2009. Total estimated Court and Case Costs spend in the four Court Departments in 2009 amounted to £10.0m, compared to a total budget of £7.5m. The 2009 Costs by Department are attached as Appendix A.
  3. The significant spend in 2009 arises in the Judicial Greffe and Law Officers’ Department and is related to a small number of costly cases.

  1. Comments
  2. The Council of Ministers has been informed of the forecast spend on Court and Case Costs throughout 2009 by way of the quarterly financial reports.  The Council has indicated that the COCF should be used to contribute towards meeting the 2009 spend.
  3. The COCF, established under the Proceeds of Crime (Jersey) Law 1999, is managed and controlled by the Minister for Treasury and Resources. The Attorney General is required to be consulted on expenditure from the COCF, and he has confirmed that the COCF can be used to fund criminal Court and Case Costs for 2009. The balance of funds available on the COCF to fund Court and Case Costs is currently c£2.5m.
  4. The use of the COCF is appropriate as its income is derived from the proceeds of criminal cases.

  1. Recommendation

That the Minister agrees to fund an amount of £2.45m of 2009 criminal Court and Case Costs from the COCF.

  1. Reason for Decision

The COCF is an appropriate source of funds for this expenditure as its income is derived from the proceeds of criminal activity.
