Jersey Competition Regulatory Authority: Chief Executive Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Jersey Competition Regulatory Authority: Approval of Chief Executive Board Appointment and Remuneration.

Decision: The Minister for Economic Development, Tourism, Sport and Culture (the “Minister”) appointed Mr Tim Ringsdore to the Board of the Jersey Competition Regulatory Authority (“JCRA”) for a further temporary  term under powers conferred by Article 3(1)(b) of the Competition Regulatory Authority (Jersey) Law 2001 (the “Law”). The appointment is effective from 1 January 2021 and will expire on 30 June 2021. The appointment is subject to Mr Ringsdore’s ongoing tenure as Chief Executive of the Authority. The Minister agreed to notify the States of the appointment in accordance with Article 3(3A) of the Law.

 

Also, in accordance with Article 5(1)(a) of the Law, the Minister approved the Chief Executive’s remuneration package paid by the JCRA, which totals £157,126 per annum.

Reasons for Decision: Mr Ringsdore’s current temporary appointment to the Board of the JCRA is due to come to an end on 31st December 2020. In order to enable a recruitment exercise for a permanent Chief Executive, overseen by the Jersey Appointments Commission, to take place, the Minister has extended Mr Ringsdore’s temporary Board appointment until 30th June 2021. In accordance with Article 3(1)(b) of the Law, the Minister extended the Board appointment of Mr Ringsdore after having first discussed this with the Chair of the JCRA. The Minister is required to notify the States of the appointment under Article 3(3A) of the Law.

Resource Implications: Fees payable to JCRA Board members are sourced from the annual grant made to the JCRA to administer the Competition (Jersey) Law 2005 (core grant of £300,000 in 2020) as well as from the JCRA’s own accounts. There are no other financial or manpower implications for the Government.

Action required: The Greffier of the States is requested to arrange for the attached report to be presented to the States as a report in the ‘R’ series to inform members of the appointment of Mr Ringsdore in accordance with Article 3 of the Law.
