Health Care (Registration) (No 4) (Jersey) Regulations 201 -

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the draft amendment ‘Health Care (Registration) (No.4) (Jersey) Regulations 201-‘ and agreed that it should be lodged in the States

Reason(s) for Decision:

To enable registered nurses, midwives and specialist community public health nurses to independently prescribe medications. This practice development is essential in the modernisation and reconfiguring of heath care organisations in order to deliver safe, effective and modern medicines management.

Resource Implications:

  • Education, training and manpower resources will be identified within existing budgets. Evidence within the UK and other countries where non medical prescribing is well established, is that of significant reduction in costs relating to medicine management.

Action required:

Greffier of the States to be requested to arrange for the draft regulations to be lodged ‘au greffe’ for debate by the States Assembly.

Explanatory Note

The object of these Regulations is to add the following registrable professions to the Schedule to the Health Care (Registration) (Jersey) Law 1995 

Midwife prescribing practitioner

Nurse prescribing practitioner

Specialist community public health nurse prescribing practitioner.

A person registered in one of these professions may (alongside doctors, dentists and veterinary surgeons) in future be prescribed as an appropriate practitioner for the purposes of the Medicines (Jersey) Law 1995. Such a practitioner is, by virtue of Article 57 of that Law, able to prescribe or administer “prescription only medicines”. However, the supply or administration of those medicines must be in conformity with the conditions prescribed under that Article.

Article 1 amends the Schedule to the Health Care (Registration) (Jersey) Law 1995 in the manner referred to above.

Article 2 sets out how these Regulations may be referred to and provides for them to come into force 7 days after they are made.

THE STATES, in pursuance of Article 17 of the Health Care (Registration) (Jersey) Law 1995, have made the following Regulations 

1 Schedule amended

In the Schedule to the Health Care (Registration) (Jersey) Law 1995 the following entries are inserted, each in its appropriate alphabetical order 

“Midwife prescribing practitioner”

“Nurse prescribing practitioner”

“Specialist community public health nurse prescribing practitioner”.

2 Citation and commencement

(1) These Regulations may be cited as the Health Care (Registration) (No. 4) (Jersey) Regulations 201-.

(2) These Regulations come into force 7 days after they are made.
