Budget transfer from Restructuring Provision to Community and Constitutional Affairs: States of Jersey Police Mobile Technology Project (SmartPolice)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Non recurring budget transfer of £225,000 in 2016 from the Restructuring Provision to Community and Constitutional Affairs (CCA) to fund costs associated with the States of Jersey Police Mobile Technology Project (SMARTPolice) in 2016.

Decision(s):

 

The Minister:

a)      requested the approval of the Minister for Treasury and Resources for a non-recurring budget transfer of £225,000 from the Restructuring Provision to the CCA revenue head of expenditure in 2016;

 

b)      approved a non-recurring budget transfer of £198,462 from the CCA revenue head of expenditure to the CCA minor capital head of expenditure in accordance with GAAP (Generally Accepted Accounting Principles) accounting;

 

c)      requested the approval of the Treasurer of a non-recurring budget transfer of £198,462 from the CCA  revenue head of expenditure to the CCA minor capital head of expenditure in 2016.

 

Reason(s) for Decision:

  • At its meeting on 9 December 2015 the Council of Ministers approved the States of Jersey Police’s bid of £1,445,000 from the Restructuring Provision for the Mobile Technology Project. The Council agreed funding as proposed for 2016 and approved “in principle” the requests for funding in 2017 and 2018. The Assistant Minister signed MD-HA-2016-0025 on 13 April 2016 seeking the approval of the Minister for Treasury and Resources for a non-recurring budget transfer of up to £773,000 from the Restructuring Provision in 2016 (and to note the indicative funding requirement of £529,800 in 2017 and £142,200 in 2018). The Minister for Treasury and Resources approved the transfer for up to £773,000 on 3 May 2016 (MD-TR-2016-0037).

 

  • Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

  • Article 18(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be transferred from a revenue head of expenditure to a capital head of expenditure, or vice versa, in order to comply with accounting standards issued for the purposes of Article 32(2).

Resource Implications:

The CCA revenue head of expenditure will increase by £26,538 and the CCA minor capital head of expenditure by £198,462 in 2016 and the Restructuring Provision revenue head of expenditure will decrease by £225,000. This decision does not change the total amount of expenditure approved by the States for 2016 in the Medium Term Financial Plan.

The Finance Director, Community and Constitutional Affairs, to seek the necessary approvals.
