Fire Precautions (Fees) (Jersey) Order 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Fees for the application for or issue and amendment of Fire Certificates required under the Fire Precautions (Jersey) Law 1977

Decision(s): The Minister made the Fire Precautions (Fees) (Jersey) Order 2010 in order to increase charges levied against the application for a Fire Certificate or the issue or amendment of a Fire Certificate.

Reason(s) for Decision:  A full review of the current charging structure applied to the application for a Fire Certificate or the subsequent issue and / or amendment of a certificate was conducted in 2010. The review concluded that the structure in place, in most cases, did not reflect the costs of the provision of the service provided by Officers of the Fire and Rescue Service’s Fire Safety Department.

 

A new structure has been developed which, for premises requiring a Fire Certificate under the Fire Precautions (Jersey) Law 1977 and having a floor area of 100 square metres or more, applies a charge which is scaleable in line with overall floor area. In this way, larger premises which require a greater amount of activity from Fire Safety Officers in conducting inspections, developing requirements for fire precautions and administering the process, attract a larger fee.

Resource Implications:  Charging for the certification process is a standing activity and therefore no additional resources are required in order to implement the Order. The additional income generated, estimated at approximately £5,000 reflects the cost of service provision only, has been identified as part of the Service’s 2011 Comprehensive Spending Review plan and has been approved as part of the States Business Plan for 2011.

Action required:  The Executive Officer, Home Affairs, to notify the Publications Editor at the States Greffe that the Order has been made and to request the Greffier of the States to arrange for the making of the Order to be notified to the States.
