Jersey Gas - change of use of car park

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s – The car parking, hereby approved, will be available for occupiers of the Jersey Gas Company Ltd offices within the site and other private users alike for a limited period of 5 years only commencing from 13th February 2006 until 13th February 2011.

Reason(s) for decision:

There is a presumption against new private non-residential car parks as stated within Policy TT28 and Policy TT1. This use will be reviewed at the end of this period in accordance with the relevant Transport Policies for private car parks. The Minister reserves the right to reconsider the use of the area of land as a car park, and the nature of the car parking permitted on the site, consequence of any changes in circumstances or policy.

Planning History

Planning Permit P/2000/1578 issued in 2000 for a change of use from external gas storage area into temporary car park for a period of 3 years.

Planning Permit P/2005/1768 issued in 2005 granted planning consent for a change of use from a temporary car park to permanent car park for occupiers of the Jersey Gas Company only.

Comments

It is clear that within the overall transport policy of the Jersey Island Plan, 2002, that the creation of new private non-residential (commuter) car parking will not normally be permitted within the scope of Policy TT28. This policy supports the wider States objective of Policy TT1 to better manage traffic, particularly in town. To ensure that parking is a tool in the overall sustainable transport policy, additional parking needs to be under public control so that an appropriate balance can be struck between supply and demand. Therefore, in the interests of the overall transport policy, the Jersey Island Plan, 2002, seeks to correct the development of land currently used for the creation of private car parks that are not related to any particular building or use. This is the basis upon which the presumption against granting planning permission for further private car parks in town is made.

Conclusion

Planning Permit P/2000/1578 was issued under the previous Island Plan and allowed for a temporary use of a portion of the Gas Works site for car parking. The category of car park was not defined or restricted on this permit.

The applicant makes the point that the current provision of car parking in this location provides a valuable facility for use by surrounding businesses.

Although the applicant has used the car park unconditionally until now it is considered that the creation and use of part of the land as a private car park, would, under the current Island Plan, be contrary to Policies TT28 and TT1. It is therefore recommended that The Minister for Planning and Environment does not approve the removal of Condition 1.
