Road Traffic (Public Parking Places) (Amendment No 5) (Jersey) Order 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Road Traffic (Public Parking Places) (Amendment No 5) (Jersey) Order 2010, to become effective seven days after it is made.

Reason(s) for Decision: Further to MD-T-2010-0070, MD-T-2010-0071 and MD-T-2-010-0079 enabling preparation of the Road Traffic (Public Parking Places) (Amendment No 5) (Jersey) Order 2010 the proposed amendments are reasonable and justified.

Resource Implications: Production and installation of new signage by the Education Sport and Culture Department (circa £2,100) and Parish of St Martin (circa £300).

Action Required: To notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States. The Education Sport and Culture Department and Parish of St Martin to install appropriate enforcement signage in relevant car parks.

ROAD TRAFFIC (PUBLIC PARKING PLACES) (AMENDMENT NO 5)

 

(JERSEY) ORDER 2010

 

 

Purpose of the Report

 

To accompany the signature copy of the Road Traffic (Public Parking Places) (Amendment No 5) (Jersey) Order 2010 enabling the inclusion of further car parking spaces (see attached schedule) in the Road Traffic (Public Parking Places) (Jersey) Order 2006 as requested by the Education Sport and Culture Department (ESCD) and the Parish of St Martin (POSM).

 

 

Background

 

ESCD have requested that a number of car parking spaces located within their facilities’ grounds be included in the Road Traffic (Public Parking Places) (Jersey) Order 2006 with the maximum stay periods as listed in the schedule.

 

In addition the Connétable of St Martin has requested that St Martins Village Green Car Park be included in the Order with a maximum stay period of 12 hours in any continuous 24 hours.

 

The Road Traffic (Public Parking Places) (Jersey) Order 2006 is administered by Transport and Technical Services as per the Road Traffic (Jersey) Law 1956.

 

 

Discussion

 

The request to create enforceable maximum stay periods for the spaces listed in the attached schedule are driven by the need to deter long term parking (which has been a persistent issue in each case) with the aim of ensuring that parking spaces are fully available to users of the relevant facilities.  Enforcement in each case will be carried out by ESCD and POSM respectively.

 

 

Recommendations

 

The Minister is recommended to approve the Road Traffic (Public Parking Places) (Amendment No 5) (Jersey) Order 2010 as prepared, with the amendment being effective from seven days of the Order being made.
