Transfer of building projects between Health and Social Services to Property Holdings

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Treasury and Resources approved the transfer of the following capital budgets and expenditure from Health and Social Services to Jersey Property Holdings.

Reason(s) for Decision: To transfer completed capital schemes to ensure correct accounting treatment.  Financial Direction 3.6 and the Public Finance (Jersey) Law 2005, state the approval of the Minister for Treasury and Resources is required for any variations to heads of expenditure above £100,000.

Resource Implications: There are no financial or manpower resource implications other than those noted in the report.

Action required: Finance Manager to inform Finance Director, Health and Social Services Department, that the capital transfers have been approved.

TREASURY AND RESOURCES MINISTER  

health and social services – transfer of building projects to jersey property holdings

 

  1. Purpose of Report

The Minister for Health and Social Services has requested the Minister for Treasury and Resources to approve capital transfers totalling £2,512,171 from Health and Social Services to Jersey Property Holdings.  Under Financial Direction 3.6 and the Public Finance (Jersey) Law 2005, the approval of the Minister for Treasury and Resources is required for any variations to heads of expenditure above £100,000.  

  1. Background

Health and Social Services wish to transfer the budgets and responsibility of the following capital projects to Jersey Property Holdings:-

* Only the Radiology element of this project is to be transferred at this time.  The continuing expenditure and remaining budget of £2,231,905 relating to Accident and Emergency works is to remain with Health and Social Services until completion.

These works are considered to increase the functionality of the General Hospital and therefore are required to be capitalised in accordance with the Capital Accounting Manual.  As the asset is the General Hospital building, it is recorded as an asset of Jersey Property Holdings, and order to allow for the capitalisation of the expenditure on these projects it is necessary for them to be transferred to Jersey Property Holdings. 

  1.     Recommendation

For the Minister for Treasury and Resources to approve Health and Social Services request to transfer the two capital projects to allow them to be capitalised in accordance with the Capital Accounting Manual.
