Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

Decision(s): The Minister made the Road Traffic (St Helier) (Amendment No. 22) (Jersey) Order 2008 And Road Traffic (Disabled Persons) (Parking) (Amendment No.7) (Jersey) Order 2008 to become effective 14 days after it is made, the purpose of which is to provide a Residents’, and Business Parking Zone in the Cheapside area of St Helier and amend the existing St Marks and Richmond Road Zones.

Reason(s) for Decision: At the request of the Connétable, to amend the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

ROAD TRAFFIC (ST HELIER) (AMENDMENT No.22) (JERSEY) ORDER 2008 AND ROAD TRAFFIC (DISABLED PERSONS) (PARKING) (AMENDMENT No.7) (JERSEY) ORDER 2008  
 
 

Purpose of the Report  

To amend the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002. 
 

Background  

The Residents’ Parking Coordinator for the Parish of St Helier, after consultation with the Transport and Technical Services Department and with the approval in principal from the Minister for Transport and Technical Services, has submitted a request for the implementation of a Residents’ and Business Parking Zone in the Cheapside area of St Helier. 

The Parish have also requested minor changes to the existing St Marks Road area Residents’ and Business Parking Zone, and a minor change to the Richmond Road Residents’ Parking Zone. 
 

Discussion  

Road Traffic (St Helier) (Jersey) Order 1996.  

The Streets affected by the proposed new Cheapside Zone are as follows:- 

  1. Old St John’s Road
  2. Westmount Road
  3. Kensington Place
  4. Lewis Street
  5. Parade Road
  6. West Park Avenue
  7. Roussel Street
  8. Peirson Road
  9. Cheapside

 

The changes to the current parking arrangements in the Cheapside area requested by the Parish, to facilitate the new Residents’ and Business Parking Zone, are as follows:- 

  1. The three current 20 minute pay-card parking spaces on the east side of Old St John’s Road to be replaced by three residents’ parking spaces, and the introduction of an additional three residents’ parking spaces on the west side. The two existing 20 minute pay-card parking spaces on the west side to remain.

 

  1. The current unloading bay on the north side of Westmount Road to be replaced by two residents’ parking spaces.

 

  1. Install an unloading bay on the western side of Kensington Place adjacent to the Grand Hotel, which is currently subject to prohibition of waiting. The times for loading and unloading to be 20 minutes, 5am to 6pm, Monday to Saturday.

 

  1. Replace four of the current 1 hour pay-card parking spaces on the north side of Kensington Place with residents’ parking spaces, and retain the remaining pay-card parking spaces.

 

  1. Reverse the traffic flow of the northern section of Lewis Street, from the current Kensington Street - Cheapside, to Cheapside - Kensington Street, to aid road safety.

 

  1. Replace five of the current public parking spaces at the Westmount Road end of the Peoples Park Car Park, with residents’ parking spaces.

 

  1. Replace five of the current 2 hour disc parking spaces on the south side of Parade Road with five residents’ parking spaces, and replace the remaining two 2 hour disc parking spaces with two 2 hour pay-card parking spaces. Introduce an additional four residents’ parking spaces and one 2 hour pay-card parking space on the south side of Parade Road, currently subject to prohibition of waiting.                                                                                                                                                                                                                                                                                                                                                                     

 

  1. Replace eighteen of the current 2 hour disc parking spaces in West Park Avenue with residents’ parking spaces, and replace the remaining three 2 hour disc parking spaces with 2 hour pay-card parking spaces.

 

  1. Replace ten of the current 2 hour disc parking spaces in Roussel Street with residents’ parking spaces, and replace the remaining six 2 hour disc parking spaces with 2 hour pay-card parking spaces.

 

  1. Replace twenty-six of the current 2 hour disc parking spaces in Peirson Road with residents’ parking spaces, and replace the remaining five 2 hour disc parking spaces with 2 hour pay-card parking spaces.

 

  1. Although doctors parking bays are not prescribed within the law, the currently marked doctors parking bay on the east side of Peirson Road will now be available to doctors from 8am to 6pm daily, and be restricted to residents only parking at other times.

 

  1. Introduce a fifteen yard section of unloading bays on the west side of Cheapside, between St Aubins Road and Lewis Street, currently subject to prohibition of waiting. The times for loading and unloading shall be 20 minutes, 5am to 6pm, Monday to Saturday.

 

  1. Replace two of the current 20 minute pay card parking spaces in Lewis Street with two residents’ parking spaces, and retain the remaining two 20 minute pay card parking spaces, and disabled persons parking bay. 

 

  1. Mark two doctors parking bays on the north side of Kensington Place, between Cheapside and Kensington Street to be reserved for permit holders between 6pm and 8am.

 

In total approximately 83 public parking spaces in the Cheapside area will be changed to spaces reserved exclusively for residents. 

A large scale colour coded plan of the Cheapside Zone is available for the Minister if required.  
 

Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002. 

  1. Introduce one disabled persons parking bay (2 hour limit) on the east side of West Park Avenue, currently subject to 2 hour disc parking.

 

A residents’ parking permit in the new Cheapside Zone will be subject to an annual fee of £200, and a business parking permit £150 per annum. Parking fees within the existing Zones to remain unchanged. 

The changes requested to the Road Traffic (St Helier) (Jersey) Order 1996 with regard to the St Mark’s Zone are as follows:- 

  1. Remove from Schedule 10. Part 1 (Parking of Vehicles on Roads for Loading and Unloading), any reference to Janvrin Road, as the currently scheduled unloading bay in this road is now to be subject to residents’ parking.

 

Minor changes have been requested to the parking places reserved for residents’ permit holders in Apsley Road, Byron Road, Oxford Road, St Marks Road, Stopford Road and Chevalier Road. 

A minor change has been requested to the parking reserved for permit holders in Richmond Road.  
 

The following requested new provisions to apply to existing residents parking areas. 

1. The Parish wish to rename the Stopford Road Zone with the name, St Mark’s    

Zone. 

2. At the Connétable’s discretion, impose a weight limit for the issue of a  residents’ parking permit for a commercial vehicle exceeding 1,600 kilograms in unladen weight (Article 33 in the Order). This restriction would not apply to a  business permit. 

3.  At the Connétable’s discretion, refuse the issue of a residents’ parking permit to residents with adequate private parking facilities at their premises within the Zone (Article 33 in the Order). 

4. Introduce Sunday pay-card parking in parking places in the new Cheapside Zone, and the current St Mark’s and Richmond Road Zones. 
 

Recommendation 

The Minister is recommended to approve the Amendments to be effective from two weeks after the Orders are made.  
 

Reason (s) for decision 

To provide a residents’ and business parking zone in the Cheapside area of St Helier.

To introduce minor changes to the existing residents’ parking areas. 
 

Action required 

To send the hard copies of the Orders to the Publications Editor at the States Greffe as soon as they have been signed.
