Jersey Harbours - delegation of staff financial authorities

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

It is necessary for the Minister to approve the delegation to officers so that they are authorised to carry out relevant functions under the Public Finances (Jersey) Law 2005 in order to enable the efficient and effective management of Jersey Harbours.

Where the word “Minister” is shown this applies to the Assistant Minister to whom certain functions have been delegated by the Minister.

1.     Introduction

The purpose of this report is to enable the Minister for Economic Development to consider, and if deemed appropriate, endorse the proposals set out in the Schedule attached to this report to delegate financial authority to the Accounting Officer and his nominated deputy/ies in accordance with the Public Finances (Jersey) Law 2005.

2.     Background

a.     Under Article 38 of the Finance Law the accounting officer of a States funded body is personally accountable for the proper financial management of the resources of the body in accordance with this Law.  

b.     Specifically, under paragraph 5.12 of Financial Direction 5.7, accounting officers are responsible for the maintenance and approval of authorised signatory lists for expenditure.

c.     The same Financial Direction requires Departments to maintain a scheme of delegation which must show those delegated the responsibility for signing off contracts and to what value. This must be approved by the minister responsible for the department.  

3.     Comments

The supporting schedules detail the proposed delegation of the Accounting Officer’s authorities under the Public Finances (Jersey) Law 2005 including those in Regulations approved under that Law and Financial Directions, to specific individuals. 

4.      Recommendation

The Minister for Economic Development is recommended to endorse the delegation of functions as listed in the attached Schedules.
