Minister for Social Security: Extension of delegation of functions in response to Covid-19

Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Minister for Social Security extension - delegation of functions in response to Covid-19.
Decision(s): In addition to ongoing ministerial delegations the Minister for Social Security signed MD-S-2021-0085 on 3rd December 2021, due to Covid-19 (Coronavirus), to maintain continued efficient administration. Having now reviewed this decision the Minister has decided to extend the delegations, as detailed below, until 1st June 2022. These delegations will be subject to ongoing review. 1. to delegate all powers and functions vested in her, and all other areas where the Minister has authority to act, to Assistant Social Security Minister – Deputy J Maçon, so that if she is unavailable, Deputy Maçon is able to cover her functions. 2. to delegate the ability to make decisions under Article 8(2) of the Income Support Jersey Law 2007 to Determining Officers appointed under the Income Support Law. Determining Officers will have the power to make a payment equivalent in value for up to 21 days Short term Incapacity Allowance. 3. to delegate the ability to make decisions under Article 8(2) of the Income Support Jersey Law 2007 to Determining Officers appointed under the Income Support Law. Determining Officers will have the power to make payments of Income Support to a household which would not normally be entitled because they have not supplied all of the written proofs required by the legislation.
Reason(s) for Decision: In addition to existing delegations, to ensure the continued efficient administration due to Covid-19 the Minister for Social Security has extended the above delegations.
Resource Implications: None as a consequence of this decision.
Action required: Private Secretary to forward a request to the Greffier of the States and Publications Editor asking for arrangements to be made for presentation to the States as a Report.
