A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Comments on Case

The application is for a new large detached dwelling in the Countryside Zone. Policy C6 presumes against all forms of new development for whatever purpose.

A high level of visual harm would derive from the introduction of the dwelling itself as well as the proposed new access points breaking through the roadside bank.

The proposed design of the house is rather bland and uninspiring – although, it is conceded that this is a Planning in Principle application and such matters could be reserved.

The land is not farmed commercially and would not represent a significant loss – however, it does have some intrinsic agricultural value.

The agent suggests that the impact of this development in the countryside would be insignificant and considerably less than other new developments in a similar setting and context eg that adjacent to the St Mary’s Inn site. However, that development was the site of a new Category A housing development surrounded by Built-Up Area (and therefore not at all similar). In any event, as stated, this would be an entirely new development in an open field – Policy C6 is there to guard against development of this nature.

It is also suggested that because the land is of limited agricultural use it might already be considered as domestic curtilage. This is not the case and, even if it were, does not over-ride the requirements of C6.

The agent also contends that because the applicant (an ex-deputy) has been active within the parish life of St Mary, it is fitting that they ought to be given the opportunity to develop the land as a retirement home. This is not a material planning matter – the only new homes which will be considered in such areas are those deemed essential to the needs of the agriculture industry.
