Sustainable Transport Policy: Ministerial Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the document entitled `Sustainable Transport Policy’ dated 02 July 2010 for subsequent presentation to the States of Jersey (publication of document to be embargoed until 19 July 2010).

Reason(s) for Decision:  The States Strategic Plan (priority 13) requires the Minister for Transport and Technical Services to prepare a sustainable transport policy for Jersey. 

Resource Implications:  Officer time at TTS and the Greffe for the publication of the policy in the form of an ‘R’.

TRANSPORT AND TECHNICAL SERVICES  

SUSTAINABLE TRANSPORT POLICY   

Purpose of the Report    

To seek the Minister’s approval of the document entitled `Sustainable Transport Policy’, dated 02 July 2010.   

Background  

The States Strategic Plan priority 13 required the Minister for Transport and Technical Services to present to the States for debate, and to implement, a Sustainable Transport Policy for Jersey in 2009, including targets, policies and timescales that reflect best practice globally, and proposals for monitoring and publishing them.  Detailed research and consultation was carried out in order to produce a policy document which adequately met those requirements and consequently the work could not be completed in 2009.   

Discussion  

The common principles of sustainable transport policy throughout the western world are to encourage more walking, cycling and public transport as well as the use of less polluting vehicles and to discourage private car use.  The Strategic Plan provides a commitment to embrace these principles and there are many good reasons for doing so as explained in the policy document.  The extensive research and consultation has resulted in a proposed policy that is appropriate, realistic and representative of the public’s views.    

Recommendation  

The Minister for Transport and Technical Services is requested to approve the document `Sustainable Transport Policy’ dated 02 July 2010 and to instruct the Chief Officer to prepare a report and proposition to be lodged “Au Greffe” on 19 July 2010.
