Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Appointment of Director of Civil Aviation for Jersey
Decision(s): The Minister for External Relations, in pursuance of Article 3 of the Civil Aviation (Jersey) Law 2008, and after seeking and receiving the advice of the States Employment Board, appointed Angus (‘Gus’) Paterson as Director of Civil Aviation for Jersey.
Reason(s) for Decision: The current Director of Civil Aviation has retired and is due to be replaced with effect from 1 August 2014. The position has previously been jointly held with Guernsey, enabling significant cost saving and consistent policy implementation across the Channel Islands, and it is proposed to continue with a joint appointment. The States of Guernsey, in a joint selection process with Jersey, have appointed Gus Paterson as DCA for Guernsey for an initial period of 5 years. The States Employment Board has approved the appointment of Gus Paterson as DCA for Jersey. Subject to this Decision, a contract between the Minister for External Relations and the Commerce and Employment Department of Guernsey will be agreed for the provision of DCA services to Jersey. The Director of External Relations shall be authorised to sign the DCA contract on behalf of the Minister.
Resource Implications: A joint appointment of DCA for Jersey and Guernsey enables a 50% cost sharing of salary and associated costs between the Bailiwicks. The financial implications of the DCA appointment are included in the overall aerodrome licence fee for Jersey airport, which will be paid by Ports of Jersey. There is no manpower requirement arising from this contract for services.
Action required: External Relations to – Confirm to Guernsey Commerce and Employment that Gus Paterson has been appointed as DCA for Jersey and, on behalf of the Minister, to sign a contract for the DCA services, initially for a period of 5 years; Inform the Greffe of this decision.
