Road Traffic (St. Saviour) (Jersey) Order 2000: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST SAVIOUR) (JERSEY) ORDER 2000 - AMENDMENT REQUEST

 

 

Purpose of the Report

 

To amend the Road Traffic (St Saviour) (Jersey) Order 2000 to introduce new one-way traffic routes, prohibition of waiting and disc parking.

 

 

Background

 

The Parish of St Saviour requested that the Road Traffic (St Saviour) (Order 2000) is amended to introduce parking restrictions to various roads across the Parish.

 

The Parish also wish to formalise the restrictions in place at the Wellington Road bus bay adjacent to Beaulieu School. It has been found that this restriction is effective at keeping the bus stop clear during school opening and closing times.

 

 

Discussion

 

Road Traffic (St Saviour) (Jersey) Order, 2000, as amended

 

Schedule 1. - One way Traffic Routes

 

Rue de la Houguette -– one-way from La Rue des Friquettes to Princes Tower Road.

 

Schedule 3. - Prohibition of Waiting

 

Rue de la Houguette – Both sides from its junction with Rue des Friquettes for a distance of 129 yards in an Easterly direction.

 

Rue des Friquettes – On the Eastern side from its junction with Rue des Pigneaux for a distance of 85 yards in a Southerly direction.

 

Clos Paumelle:–

 

  • On the Northern side from its junction with “Bagatelle Road” to its junction with “Croix de Bois.

 

  • On the Eastern side from its junction with “Croix de Bois” for a distance of 40 yards in a Southerly and Easterly direction to the Western pillar of the gateway to number 13.

 

  • From the Northern pillar of the gateway to number 51 for a direction of 82 yards in a Northerly, Easterly and Southerly direction to the Northern pillar of the gateway to number 52.

 

  • From the Southern pillar of the gate to number 45 for a distance of 82 yards in a Southerly, Easterly and Northerly direction to the Southern pillar of the gateway to number 58.

 

 

 

Langley Avenue– Both sides from a point 160 yards from its junction with St Saviour’s Road for a distance for 80 yards in a westerly direction.

 

 Langley Park:-

 

  • On its Southern side starting at a distance of 295 yards from Les Grands Vaux for a distance of 35 yards in a North Easterly direction.

 

  • On the Southern side starting at a distance of 180 yards from Les Grands Vaux for a distance of 50 yards in an Easterly direction.

 

  • Replace existing entry with the following:-

“Both sides, (from its junction with Grands Vaux for a distance of 67 yards in an Easterly direction)”.

 

Rue a la Dame:-

 

  • East side (from its junction with Grands Vaux for a distance of 66 yards in a southerly direction);

 

  • West side (from its junction with Grands Vaux for a distance of 20 yards in a southerly direction);

 

  • West side (from a point 42 yards from its junction with Grands Vaux for a distance of 21 yards in a Southerly direction).

 

 

Schedule 4 part 2. Roads not to be used by vehicles exceeding 6 Feet 6 inches in width
