Property and Infrastructure Regeneration: Appointment of Member to the Regeneration Steering Group

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Property and Infrastructure Regeneration: Appointment of Member to the Regeneration Steering Group.

Decision(s):

The Chief Minister agreed to lodge ‘au Greffe’ the Report and Proposition recommending the appointment of the Connétable of St. Helier as a member of the Regeneration Steering Group.

Reason(s) for Decision: On 13th October 2010 the States approved new arrangements brought forward by the Council of Ministers for structuring the planning, development and implementation of major property and infrastructure regeneration projects in Jersey (P.73/2010).

An amendment lodged by Senator B.E. Shenton was also approved by the States, which made provision for a member of the States elected by the Assembly with a St. Helier mandate (namely a Senator, the Connétable of St. Helier or a St. Helier Deputy) to be a member of the Regeneration Steering Group.

 

Accordingly, the Chief Minister wishes to lodge a Proposition recommending to the States Assembly that it appoints the Connétable of St. Helier as a member of the Regeneration Steering Group.

Resource Implications: There are no resource implications.

Action required: The Greffier of the States is requested to arrange for the attached Report and Proposition to be lodged ‘au Greffe’ with a request for debate at the earliest opportunity.

PROPOSITION

 

THE STATES are asked to decide whether they are of opinion -

 

a)      To refer to their Act dated 13th October 2010 in which they adopted the Proposition entitled ‘Property and Infrastructure Regeneration: the States of Jersey Development Company Limited’ as amended (P.73/2010) setting out the proposals and structure of the new Property and Infrastructure Regeneration process and establishing the States of Jersey Development Company Limited; and

 

b)      to approve the appointment of Connétable A.S. St. Helier as a member of the Regeneration Steering Group.

REPORT

 

Background

 

On 13th October 2010 the States approved proposals lodged by the Council of Ministers that set out new arrangements for structuring the planning, development and implementation of major property and infrastructure regeneration projects in Jersey (P.73/2010).

 

A key provision of the proposals included the formation of a Regeneration Steering Group.

 

The purpose of the Regeneration Steering Group is to provide political guidance in order to inform the policy guidelines for all major Public property and regeneration projects in Jersey.

 

This will in practice mean that the Regeneration Steering Group translates Masterplans and Development Briefs proposed by the Minister for Planning and Environment into workable and viable Development Plans.

 

Having approved a Development Plan, the Steering Group will pass this to the States of Jersey Development Company who will take responsibility for its implementation. To this extent, the Regeneration Steering Group will provide a guiding framework for the activities of the States of Jersey Development Company in delivering a particular Development Plan.

 

By means of the Regeneration Steering Group, the Public will also retain an interest in each regeneration project throughout the delivery process.

 

Composition

 

The membership of the Regeneration Steering Group is as follows:  

 

  •      the Chief Minister (Chairman)
  •      the Minister for Treasury and Resources
  •      the Minister for Economic Development
  •      the Minister for Transport and Technical Services
  • a member of the States elected by the Assembly with a St. Helier mandate (namely a Senator, the Connétable of St. Helier or a St. Helier Deputy)
  •      a co-opted Connétable for a Parish in which a major regeneration scheme is taking place

 

The Regeneration Steering Group is accountable to the Council of Ministers for its activities.

 

Appointment

 

The Proposition (P.173/2010) approved by the States originally provided that the Connétable of St. Helier should automatically be a member of the Regeneration Steering Group.

 

However, an amendment lodged by Senator B.E. Shenton was subsequently approved by the States, which made provision instead for a member of the States elected by the Assembly with a St. Helier mandate (namely a Senator, the Connétable of St. Helier or a St. Helier Deputy) to be a member of the Regeneration Steering Group.

 

The Chief Minister, as Chairman, therefore recommends that the Connétable of St. Helier be appointed as a member of the Regeneration Steering Group.

 

The appointment of the Connétable of St. Helier is particularly important because a large number of the proposed regeneration projects will take place in the Parish. The knowledge and experience of the Connétable are therefore vital to ensuring that the interests of St. Helier residents are represented. Likewise, it will ensure that an understanding of Parish matters is brought to the attention of the Steering Group.

 

While the Regeneration Steering Group requires a clear link to the Parish of St. Helier, the Chief Minister also wishes to emphasise that the revised regeneration process presents many opportunities with which States Members can engage.

 

With this in mind, the Chief Minister wishes to properly constitute the Regeneration Steering Group as it begins oversight of all property and regeneration projects in Jersey.

 

Financial and manpower implications

 

There are no financial or manpower implications arising for the States from this appointment.
