A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for decision:

Application referred to Minister by Planning Application Panel which was minded to refuse notwithstanding Officer Recommendation to approve.

The proposed dwelling by reason of its scale, mass and height is considered to have an unacceptable impact on the landscape, and therefore fails to satisfy the requirements of Policies G2, G3, G15 and H8 of the Jersey Island Plan.

It is considered that the top floor north facing windows and balcony will lead to an unacceptable level of overlooking of the adjacent property. The proposal therefore fails to satisfy the requirements of Policies G2 and H8 of the Jersey Island Plan.

Summary/

Conclusion

The Planning Applications Panel visited the site and surrounding area on 22 May and considered the application in public on 23 May, receiving comments from Mr Crill (objector), Mr Dodge (objector), Mr Ruane (applicant) and his agents, Mr Andrews, Mr Le Sueur and Mr Kolbe.

The Panel deferred consideration of the application and asked that a profile of both the front and rear gables be erected so as to clearly illustrate the scale of the roof of the proposed building.

The Panel also asked to view the site from Mr Crill’s property.

In accordance with normal practice, no representations should be made to the Panel on site, either for, or against the proposals, and as the Panel have already received oral presentations at 23 May meeting it would be normal practice not to reopen discussion at the next public meeting.

The previous site visit report of 14 May 2007 is attached setting out the Department’s views and recommendation for approval.

Since that report was published, the Department has received a letter of support and a further letter withdrawing one of the original objections. A further objection has also been submitted, and a letter from one of the previous objectors. These are all attached as background papers.
