Capital Budget Virements.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister agreed to the recommended budget virements.

Reason(s) for decision

The Housing Department has been allocated a Capital Budget of £6m for 2007 and has an existing rolling budget of £191,626.72. The £6m budget needs to be added to the Department’s rolling capital budget. For the purpose of carrying out initial stages of and implementation and completion of capital building works, and as a result of changes in project priority allocation of the rolling budget, virements of exiting budgets need to be effected to provide accurate reporting and effective project management.

The annexed summary report provides details of the reasons for the virements.

Report to the Minister For Housing

Virement of Capital Budgets

To consider the allocation of the £6m capital budget for 2007 to the Housing Department’s Rolling Capital Vote and re-allocation of existing budgets to projects with high priority.

Background

The Housing Department has a number of open Capital projects which require additions to or transfers from their respective budgets. Their position and proposals are described below:

HYC016 – Ann Court Refurbishment

Feasibility work has been completed in the project working towards refurbishment of these properties. Plans for the site have now changed and the Housing Department is no longer progressing with the refurbishment plans.

Transfer £61,349.32 from the Housing rolling vote to cover the current expenditure which has exceeded the amount initially budgeted.

HYC017 – Le Coin Flats

These flats are to be demolished in the very near future. Some costs have been incurred leading to the demolition and the cost of demolition needs to be met.

Transfer £100,000 from the Housing rolling vote to the budget to cover further anticipated costs of demolition work.

HYC019 – The Cedars Renovation

The project as commenced. And further costs will be met during 2007 for which a budget needs to be provided.

Transfer £300,000 from the Housing rolling vote to cover costs up to commencement on site.

HYC020 – Le Squez redevelopment

There is a surplus budget in this project as a result of the sale of homes the receipts of which are part of the overall refurbishment scheme’s funding. This income surplus is required to support the second phase of the Le Squez project, phase 1b.

Transfer £3,566,184.73 to HYC024 – Le Squez phase 1b.

HYR028 – Victoria Cottage Homes Modernisation

Completed works.

Transfer the remaining budget of £249,069.05 to project HYR025 – Clos Du Fort for refurbishment of those premises

HYR027

Project now completed. Minor additional works carried out post-completion.

Transfer £2,024.66 from rolling vote to HYR027

In addition the Department has been allocated £6m for capital projects for 2007. This budget should be added to the Department’s rolling capital vote for allocation to projects.

Recommendation

The Minster is recommended to approve the allocation and transfers described in this report to facilitate continuation of these projects and reporting thereon.
