Authorisation to issue a fish farming licence to La Rocque Fisheries Ltd.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for decision:

Following the authorisation by the Minister to allow publication in the Jersey Gazette, the draft licence was advertised on 21 and 25 April 2006. The period during which any objections to the granting of this licence could be made expired on 21 May 2006. No objections were received.

Action required:

Fisheries Officers will issue the licence to La Rocque Fisheries Ltd subject to the conditions governing intertidal aquaculture.

Purpose of the Report

In order to manage the marine resources of Jersey in the best interests of the General Public.

Background

On 12 April 2006 the Minister for Planning and Environment granted permission to publicise the draft licence to La Rocque Fisheries Ltd of La Rue de la Sente Maillard, Grouville JE3 9BS concerning the appropriation of a portion of the seabed for the cultivation of oysters (Crassostrea gigas.) (copy of licence attached).

Details

(a) Under the Sea Fisheries (Establishment and Regulation of Fisheries) (Jersey) Regulations 1998 for one month after the publication of the draft licence the Minister shall receive any objections made in writing concerning the proposed licence.

(b) The draft licence was publicised in the Jersey Gazette on both 21 and 25 April 2006 and the period during which objections could be received expired on 21 May 2006. During this time no objections were received.

(c) Under paragraph 3(1) of the same Regulations the Minister may issue a licence subject to certain conditions as it sees fit (copy attached). These conditions pertain to all intertidal fish farming concessions.

Recommendation

The Minister is requested to authorise Fishery Officers to issue a fish farming licence to La Rocque Fisheries Ltd.
