A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision: Article 21 of the Public Finances (Jersey) Law 2019 states that if, during a financial year, the Minister is satisfied that the income of a States funded body or area of operation is likely to exceed the estimate for that income, the Minister may authorise the withdrawal of that excess amount from the Consolidated Fund during that year. A case for funding from the COCF has been made by the department. The Attorney General has consented to the use of the Fund for this project in a letter dated 16th July 2019.
Resource Implications: The COCF to decrease by £1,803,762 and the capital head of expenditure Prison Phase 6 FA0MF18025 within Growth, Housing and Environment department to increase by the same amount. This decision is made following approval of the 2020 capital programme in the Government Plan 2020-2023 and does not change the total amount of expenditure proposed in the Government Plan.

Applications of COCF funding to Growth, Housing and Environment Department to assist with the Prison Masterplan

Purpose of Report

To enable the Minister to approve the allocation of up to £1,803,792 from the Criminal Offences Confiscation Fund to Growth, Housing and Environment department as detailed below.

Background

Prison Masterplan

Championed by the new Governor, the States of Jersey Prison Service and Jersey Property Holdings have undertaken a review of the 2008 Masterplan with the aim of rationalising and consolidating the remaining redevelopment into more economic and fewer phases.

The outcome of the review was to consolidate the remaining 5-7 phases in to 2.

Phase 7a – Demolition of A, B & C Wings in preparation for the new build, and relocation of the Atlas Lock Hub. Planning permission for this is already granted, and this can commence as soon as funding is approved. This will now be allocated to Phase 6 of the existing project.

Phase 7 – A new multi-purpose building that will provide fit for purpose Education, Training, Care and Separation (Segregation Unit) and Healthcare facilities.

Phase 8 – A new Out Placement Unit (on the Prison Estate, but out with the main secure fence) and the replacement of the outer security fence (which will be circa 50 years old, and requires replacement due to weathering / rusting of main upright posts), and completion of the Hard landscaping for the Gate House & the unit. The proposed new building will be situated in the car park area and could commence at the tail end of phase 6.

The proposed updated Masterplan (2019) was presented to the Minister for Community & Constitutional Affairs on the 13 February 2019. A subsequent site visit was made by the Minister on the 5 March 2019.

A Ministerial Decision Reference MD-HA-2019-0028 was signed by the Justice and Home Affairs Minister on the 18/3/2019 endorsing the proposed updated masterplan.

Whilst drafting the capital programme for the Government Plan 2020-2023, it was recommended that Phase 6 could be funded from the COCF.

The Attorney General has consented to the use of the COCF for this project in a letter dated 16th July 2019.

Recommendation

Based upon the advice of the Attorney General, the Minister is recommended to approve the allocation of up to £1,803,762 from the Criminal Offences Confiscation Fund (COCF) to the capital head of expenditure Prison Phase 6 FA0MF18025 within the Growth, Housing and Environment department for the above project.

This decision is pending approval of the 2020 capital programme in the Government Plan 2020-2023 and does not change the total amount of expenditure proposed in the Government Plan.
