Pleasant Street - pavement improvement

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

 

1. The Minister approved, as recommended by Property Holdings, the passing of a contract of exchange and counter-exchange with Rex (Jersey) Ltd to acquire a strip of land on Pleasant Street for road widening purposes measuring approximately 74.68 sq m, and to transfer to Rex (Jersey) Ltd an area of public land adjoining the site of the former Rex Hotel measuring approximately 29.20 sq m, the consideration in both cases being a nominal sum of £10; it being conditional upon Rex (Jersey) Ltd laying a new pavement, at its cost, on Pleasant Street adjoining its site, and meeting the Public’s legal fees in connection with passing contract before the Royal Court.

 

 

Reason(s) for Decision:

 

1.  Under Standing Order 168 (1) (a) and 168 (3) the Minister hereby notified the States that he had accepted the recommendation of Property Holdings to agree to the above land transaction.

 

2.  Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

 

Resource Implications:

 

Other than those detailed in the report there are no further financial Implications. There are no manpower implications.

 

Action required:

 

1. In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed.  After the expiry of 15 working days following presentation to the States the transaction may be concluded.

 

2. The Director of Property Holdings is to instruct the Attorney General and the Greffier to pass the necessary contract, and to copy this decision to the Minister, Treasurer and Deputy Treasurer.

Revisions to previous report

This transaction was previously approved on 03 November 2004 by the former Environment and Public Services Committee (under delegated authority) and on 15 November 2004 by the former Finance and Economics committee (also under delegated authority).

However, the contract of exchange and counter-exchange between the Public and Rex (Jersey) Ltd was not passed before Royal Court due to planning issues with the redevelopment scheme for the former Rex Hotel.

Those issues have now been resolved, and there are minor changes to the areas of land being transferred. The revised report is therefore as follows:

Background:

Rex (Jersey) Ltd (a development company set-up by Dandara Jersey Ltd) is proposing to redevelop the site of the former Rex Hotel on St Saviour’s Road as housing units (for location, refer to plan 635 (D1)).

As part of the scheme, Rex (Jersey) Ltd has agreed to create, at its cost, a minimum 1.95 metre wide pavement along the length of the site bordering Pleasant Street, maintaining a 4.0 metre wide carriageway. It will therefore be necessary for Rex (Jersey) Ltd to cede to the Public a strip of land on which the new pavement will be laid.

In exchange, Rex (Jersey) Ltd requires a small parcel of land which forms part of a larger area acquired by the Public from a Mr William Cabot in 1980, being situated to the rear of n° 35 St Saviour’s Road (now part of the Rex Hotel site). The land was acquired by the Public for road widening purposes, but the project was never effected. Part of the land will, however, now form a section of the proposed 1.95 metre wide pavement along Pleasant Street. The remaining small parcel of land required by Rex (Jersey) Ltd serves no useful purpose to the public.

Terms:

The following in-principle terms have therefore been agreed with Dandara Jersey Ltd:

Parties to contract:

The Public of the Island of Jersey on the one part as the owner of Pleasant Street, and Rex (Jersey) Ltd on the other part as the owner of the Former Rex Hotel site, St Saviour’s Road.

 

Consideration:

The Public will acquire from Rex (Jersey) Ltd a strip of land adjoining Pleasant Street shown with vertical line hatching on drawing n° JY39-DA-401, having an approximate area of 74.68 sq m, for the sum of £10.

 

Rex (Jersey) Ltd will acquire from the Public a parcel of land to the rear of n° 35 St Saviour’s Road (adjoining Pleasant Street) shown cross hatched on drawing n° JY39-DA-401, having an approximate area of 29.20 sq m, for the sum of £10.

 

Fees:

Rex (Jersey) Ltd will meet the Public’s legal fees in connection with approving and passing the contract before the Royal Court.

 

Other terms:

Rex (Jersey) Ltd will construct, at its own cost, a new minimum 1.95 metre wide pavement along the full length of its redevelopment site bordering Pleasant Street, as shown upon drg n° JY39-DA-401, maintaining a 4.0 metre wide carriageway, wholly to the satisfaction of the Transport and Technical Services Department, including making good the carriageway surface as required adjacent to the new pavement.

 

Recommendation

It is recommended that the Public enters in a contract of exchange and counter- exchange with Rex (Jersey) Ltd to acquire a strip of land on Pleasant Street for road widening purposes measuring approximately 74.68 sq m, and to transfer to Rex (Jersey) Ltd an area of public land adjoining the site of the former Rex Hotel measuring approximately 29.20 sq m, the consideration in both cases being a nominal sum of £10; it being conditional upon Rex (Jersey) Ltd laying a new pavement, at its cost, on Pleasant Street adjoining its site, and meeting the Public’s legal fees in connection with passing contract before the Royal Court.
