Draft Sea Fisheries Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The draft Sea Fisheries (Licensing of Fishing Boats)(Amendment No. 2)(Jersey) Regulations 200- are approved for lodging and debate on 12 September 2006.

Reason(s) for decision:

The amendment replaces the requirement that all fishing vessel licences are renewed annually with a requirement that they be renewed every two years. This will reduce the administrative burden and thus costs placed on professional fishermen and staff of the Environment Division.

States Greffe to arrange for the draft to be lodged and for the draft to be debated in sufficient time to allow implementation prior to the end of 2006

Purpose of the Report

To approve the draft Sea Fisheries (Licensing of Fishing Boats) (Amendment No 2) (Jersey) Regulations 200- and to authorise that those Regulations be lodged for debate within a timescale that will allow for their implementation prior to the end of 2006.

Background

The Environment and Public Services Committee approved the drafting of the Sea Fisheries (Licensing of Fishing Boats) (Amendment No.2) (Jersey) Regulations at their last meeting on 17th November 2005.

The amendment seeks to reduce the administrative burden on both fishermen and administrators by bringing Jersey in to line with the United Kingdom and Guernsey by increasing the period of validity of fishing boat licences from one to two years.

Discussion

The annual renewal of fishing licences was originally necessary to ensure that records were kept up to date. Since the introduction of the licensing scheme tighter links have been established with the Registry and fishermen understand better the need to notify administrators of changes in details, rendering the need for annual renewal an unnecessary burden on both administrators and fishermen.

There are some 200 fishing boat licences and at the end of each year the applicant has to apply for the licence to be renewed for the following year. Each licence comprises of between 12 and 20 pages and so there are financial and manpower costs associated with licence renewal.

Recommendation

It is recommended that the draft be approved and lodged for debate within an appropriate timescale to allow implementation prior to the end of 2006.
