Criminal Injuries Compensation Board: Re-Appointment of Member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Criminal Injuries Compensation Board – Re-Appointment of Member

Decision(s): The Minister for Home Affairs agreed to the recommendation that Mrs Janet Carlin be re-appointed as a member of the Criminal Injuries Compensation Board for a period of 6 months from 30th April 2016 until 31st October 2016.

 

Reason(s) for Decision: Mrs Carlin has been a member of the Board since 2011 and her initial term of office is coming to an end. Mrs Carlin wishes to remain in post for a further six months until 31st October 2016. This extension will enable Mrs Carlin to complete her ongoing cases and has the support of the Chairman of the Board.

 

Resource Implications: Members of the Board are entitled to receive such remuneration and allowances as the Minister may determine.

 

Action required: The Secretary to the Criminal Injuries Compensation Board is to be notified of this re-appointment.

Re-Appointment of one member to the Criminal Injuries Compensation Board

 

 

Background

 

The Criminal Injuries Compensation Scheme (CICS) is administered by the Criminal Injuries Compensation Board (CICB).

 

The Scheme provides that the Board will consist of not more than twelve members, not less than three of whom shall be advocates or solicitors of the Royal Court of not less than five years’ standing. Members of the Board are appointed by the Minister for Home Affairs, for five years in the first instance, and their appointment is renewable for such periods as the Minister may think appropriate. One Member, who is an advocate or solicitor of not less than five years’ standing, is appointed by the Minister as Chairman of the Board.   

 

The Board currently consists of five advocates or solicitors and two other members, one of whom, Mrs Janet Carlin, this Report recommends for re-appointment.

 

Re-Appointment of Member

 

Mrs Janet Carlin has been a member of the Board since 2011 and her initial term of office is now coming to an end. Mrs Carlin wishes to remain in office for a further six months until 31st October 2016 at which point she will step down from the Board. This extension will enable Mrs Carlin to complete her ongoing cases and avoid the need for a new member to become familiar with the relevant documentation. The Chairman of the Board is content with this six month extension.

 

Recommendation

 

It is recommended that the Minister approves the extension of Mrs Carlin’s term of office.
